【摘要】：居住權(quán)制度自羅馬法建立以來，大陸法系各國都紛紛效仿建立了居住權(quán)制度以此來實(shí)現(xiàn)“居者有其屋”的目標(biāo)。我國現(xiàn)有的物權(quán)法中具備居住權(quán)制度所需要的用益物權(quán)體系，也存在居住權(quán)制度的立法空間，現(xiàn)實(shí)生活中住房的緊缺以及經(jīng)濟(jì)條件的限制等等都決定了居住權(quán)制度設(shè)立的必要性和可行性。我國居住權(quán)制度起步較晚，所以無論是在法理研究還是在法律制度上都不盡完善，其表現(xiàn)在物權(quán)法草案中關(guān)于居住權(quán)制度的設(shè)計(jì)上。因此本文在對大陸法系各國關(guān)于居住權(quán)制度的規(guī)定進(jìn)行論述和歸納居住權(quán)制度的發(fā)展軌跡上，，對居住權(quán)制度的價(jià)值理念以及其具體的制度設(shè)計(jì)進(jìn)行了探討，以求進(jìn)一步完善我國物權(quán)法中關(guān)于居住權(quán)制度的規(guī)定。
[Abstract]:Since the establishment of the right of residence system in Rome law, the countries of the continental law system have followed the establishment of the residence right system in order to achieve the goal of "the house has its own house". The limitation of economic conditions and so on determines the necessity and feasibility of the establishment of the residence right system. The system of residence right in China starts late, so it is not perfect both in legal and legal system. It is manifested in the design of the system of residence right in the draft of property law. The article discusses and summarizes the development track of the residence right system, discusses the value concept of the residence right system and its specific system design, in order to further improve the regulations on the right of residence in the property law of our country.
