【摘要】：2001年修正的《婚姻法》與2003年修正的《婚姻登記條例》對登記離婚制度進(jìn)行了一系列改革。新婚姻登記條例簡化了離婚登記手續(xù),體現(xiàn)了“服務(wù)”、“自由”和“平等”的特色。但同時也引發(fā)了與《婚姻法》中的有關(guān)規(guī)定相沖突的現(xiàn)象,即過于追求“離婚自由”,忽視離婚制度一貫以來堅持的指導(dǎo)思想——“反對輕率離婚”�；橐龅怯洺绦虮憷耐瑫r,也給社會帶來了許多負(fù)面影響,并且對婚姻登記工作進(jìn)一步規(guī)范化提出更高的要求。對此本文提出一系列對策以完善我國登記離婚制度。 本文在前人的研究成果的基礎(chǔ)上,先從我國登記離婚制度的概述入手,簡要介紹了登記離婚制度的條件、程序及法律效力,以及登記離婚制度存在的基礎(chǔ),回顧了我國登記離婚制度的歷史發(fā)展過程,以及和國外主要國家、港澳臺的登記離婚制度進(jìn)行比較,然后就我國目前登記離婚制度的現(xiàn)狀進(jìn)行了探究。 本文最后一章針對我國目前的登記離婚制度的缺陷提出了一系列建議,包括:規(guī)定適當(dāng)?shù)碾x婚考慮期;完善登記離婚制度的審查程序;明確對假離婚現(xiàn)象處理的權(quán)限;建立分居制度;完善離婚登記無效確認(rèn)制度;完善對未成年子女利益妥善處理的措施等。
[Abstract]:The Marriage Law, amended in 2001, and the Marriage Registration regulations, amended in 2003, have carried out a series of reforms on the registration and divorce system. The new marriage registration rules simplify the registration of divorce and embody the characteristics of service, freedom and equality. But at the same time, it also causes the phenomenon of conflict with the relevant provisions of the Marriage Law, that is, the excessive pursuit of "freedom of divorce" and the neglect of the guiding ideology that the divorce system has always adhered to-"opposing frivolous divorce". At the same time, it has brought many negative effects to the society, and put forward higher requirements for the further standardization of marriage registration. This paper puts forward a series of countermeasures to perfect the divorce registration system in China. On the basis of the previous research results, this paper begins with an overview of the system of registered divorce in our country, and briefly introduces the conditions, procedures and legal effects of the system of registered divorce, as well as the basis for the existence of the system of registered divorce. This paper reviews the historical development of the divorce registration system in our country, and compares it with that of Hong Kong, Macao and Taiwan, and then probes into the present situation of the registration divorce system in our country. The last chapter of this paper puts forward a series of suggestions on the defects of the current system of registered divorce in China, including: stipulating the appropriate period of consideration for divorce; perfecting the examination procedure of the system of registered divorce; defining the authority to deal with the phenomenon of false divorce; Establish separation system; perfect the system of invalid confirmation of divorce registration; perfect the measures to properly deal with the interests of minor children.
