【摘要】：改革開放以來,我國經(jīng)濟(jì)、科技、衛(wèi)生等方面取得了輝煌成就,人民生活水平、健康狀況得到了極大改善。隨之而來的是人口老齡化問題。人口老齡化意味著贍養(yǎng)義務(wù)人比例下降而贍養(yǎng)權(quán)利人比例上升,這無疑會(huì)給老年人的贍養(yǎng)產(chǎn)生影響。從新聞媒體的報(bào)道及調(diào)查數(shù)據(jù)來看,當(dāng)前老年人的贍養(yǎng)存在諸多問題,很多老年人的生活狀況令人堪憂。我國的社會(huì)保障還不完善,特別是廣大農(nóng)村,十分薄弱。要把養(yǎng)老責(zé)任一下子推向社會(huì),目前還不現(xiàn)實(shí)。傳統(tǒng)的家庭養(yǎng)老仍是我國最主要、不可替代的養(yǎng)老模式。而道德對“贍養(yǎng)行為”的束縛力卻越來越有限,老年人的贍養(yǎng)必須依靠法律制度來解決。由于起步晚、基礎(chǔ)差、時(shí)間短,我國贍養(yǎng)法律制度還不完善,導(dǎo)致贍養(yǎng)案件出現(xiàn)了四難:起訴難、舉證難、裁判難、執(zhí)行難。隨著贍養(yǎng)問題的日益凸出,相關(guān)法律規(guī)定的完善迫在眉睫。 本文共分四章。 第一章:贍養(yǎng)制度概述。主要對贍養(yǎng)的概念、贍養(yǎng)法律關(guān)系的特征以及贍養(yǎng)制度的現(xiàn)實(shí)意義等方面作了探討。 第二章:贍養(yǎng)制度國外立法比較。分別對歐美國家和亞洲國家的贍養(yǎng)制度立法作了簡介、分析和概括,指出文化背景不同,贍養(yǎng)制度會(huì)有差異,但立法宗旨與基本框架大體相同。 第三章:我國贍養(yǎng)制度立法分析。對我國現(xiàn)行贍養(yǎng)立法進(jìn)行分析,找出立法存在的問題。主要有三方面:一是立法分散,各法之間不太一致;二是過于簡單,有些規(guī)定不明確、不詳細(xì);三是立法粗糙,遺漏了一些必要的規(guī)定。 第四章:我國贍養(yǎng)制度立法之完善。針對我國贍養(yǎng)立法存在的問題,在借鑒國外立法經(jīng)驗(yàn)的基礎(chǔ)上,結(jié)合我國當(dāng)前實(shí)際,提出了具體的立法完善措施。主要有:一、指出規(guī)定不一致的地方,提出具體修改建議;二、擴(kuò)大贍養(yǎng)義務(wù)人的范圍;三、明確精神贍養(yǎng)的地位和內(nèi)容;四、增加贍養(yǎng)的順序、標(biāo)準(zhǔn)、贍養(yǎng)權(quán)的喪失等規(guī)定。 今年是第六次人口普查年,筆者相信:老年人口數(shù)量無論是絕對值還是相對值肯定都會(huì)又上一個(gè)新臺(tái)階。關(guān)愛、關(guān)心老年人,是全社會(huì)的共同責(zé)任。
[Abstract]:Since the reform and opening up, China's economy, science and technology, health and other aspects have made brilliant achievements, people's living standards, health conditions have been greatly improved. This is followed by the ageing of the population. The aging of the population means that the proportion of maintenance obligor decreases and the proportion of the right holders increases, which will undoubtedly have an impact on the maintenance of the elderly. From the news media reports and survey data, there are many problems in the maintenance of the elderly, and many elderly people's living conditions are worrying. China's social security is not perfect, especially in the vast rural areas, very weak. It is not realistic to push the responsibility for the aged to the society at once. Traditional family pension is still the most important and irreplaceable pension model in China. However, the moral constraint on maintenance behavior is becoming more and more limited, and the support of the elderly must depend on the legal system. Because of the late start, poor foundation, short time and imperfect legal system of maintenance in our country, there are four difficulties in the maintenance cases: the difficulty of prosecution, the difficulty of proof, the difficulty of judgment and the difficulty of execution. With the increasing protruding of the problem of maintenance, the perfection of relevant laws and regulations is imminent. This paper is divided into four chapters. Chapter one: summary of maintenance system. This paper mainly discusses the concept of maintenance, the characteristics of legal relationship of maintenance and the practical significance of maintenance system. The second chapter: foreign legislation comparison of maintenance system. This paper introduces the legislation of maintenance system in European and American countries and Asian countries, analyzes and generalizes it, and points out that different cultural backgrounds will lead to differences in maintenance system, but the legislative purpose and basic framework are basically the same. The third chapter: the legislation analysis of our country's maintenance system. This paper analyzes the current maintenance legislation of our country and finds out the problems existing in the legislation. There are three main aspects: first, the legislation is scattered, the laws are not very consistent; the second is too simple, some provisions are not clear, not detailed; third, the legislation is rough, missing some necessary provisions. Chapter four: the perfection of our country's maintenance system legislation. In view of the problems existing in the maintenance legislation of our country, on the basis of drawing lessons from the foreign legislative experience and combining the current situation of our country, the author puts forward the concrete legislative perfection measures. Mainly have: first, point out the place that the regulation is inconsistent, put forward the concrete amendment proposal; second, expand the scope of the support obligor; third, make clear the status and content of the spirit support; fourth, increase the order of maintenance, standard, the loss of the right of maintenance and so on. This year is the sixth census year, the author believes that the number of the elderly population, both absolute and relative, will surely rise to a new level. Caring and caring for the elderly is the common responsibility of the whole society.
