【摘要】：丹寧勛爵作為二戰(zhàn)后英國最著名的法官之一,通過其司法活動(dòng),極大地促進(jìn)了英國法律的改革和發(fā)展。丹寧勛爵在其自傳《家庭生活》中將自己的法律思想概括為“實(shí)現(xiàn)公正”、“法律下的自由”和“信奉上帝”,這三個(gè)方面始終貫穿著丹寧勛爵的司法和學(xué)術(shù)活動(dòng),是他獲得法律成果的思想基礎(chǔ)。英國遵循判例主義,身為高等法官的丹寧勛爵,正是通過案件的審判直接推動(dòng)了英國法律的發(fā)展。例如,丹寧勛爵在“高樹案”中創(chuàng)設(shè)了允諾禁止反言原則,彌補(bǔ)了約因的缺陷;在“瑪麗瓦訴國際散裝貨船公司案”中發(fā)布了瑪利瓦禁令,為債權(quán)人提供了有效地訴訟救濟(jì)。在行政法領(lǐng)域,通過一系列案件的審判擴(kuò)大了法院對(duì)公共機(jī)關(guān)的司法審查范圍,遏制了行政權(quán)力的濫用;在審理家庭案件時(shí),確立了被遺棄妻子的居住權(quán)和在家產(chǎn)中財(cái)產(chǎn)份額保護(hù),促進(jìn)了家庭法的改革;并且結(jié)合自身的司法實(shí)踐提出了對(duì)法律援助和誹謗法的改革建議,等等。這些貢獻(xiàn)很大程度上改變了英國法律的發(fā)展軌跡,使英國法律順應(yīng)并促進(jìn)了英國現(xiàn)代社會(huì)的發(fā)展。雖然我國法律同英國法律屬于不同法系,但是這并不妨礙我們吸收英國相關(guān)成熟的法律制度和西方學(xué)者進(jìn)步的法律思想。丹寧勛爵司法公正和保障自由的法律思想值得我們學(xué)習(xí),而他對(duì)二戰(zhàn)后英國法律改革所做的具體貢獻(xiàn)則為完善我國相關(guān)方面的法制建設(shè)提供了有益的啟示。
[Abstract]:As one of the most famous judges in England after World War II, Lord tannin greatly promoted the reform and development of English law through his judicial activities. In his autobiography, Family Life, Lord tannin summed up his legal ideas as "achieving justice", "freedom under the law" and "believing in God". These three aspects have always permeated Lord tannin's judicial and academic activities. It is the ideological foundation on which he obtained legal results. In England, following the doctrine of jurisprudence, Lord tannin, as a high judge, directly promoted the development of English law through the trial of cases. For example, Lord Denning made up for the defect of the cause by creating the principle of estoppel in the High Tree case, and in Mariva v. International bulk Carrier Corporation, he issued the Maryva injunction, which provided effective litigation relief for creditors. In the area of administrative law, the judicial review of public authorities by the courts has been expanded through a series of trials, containing the abuse of administrative power; in family cases, It establishes the right of residence of the abandoned wife and the protection of the property share in the home labor, promotes the reform of the family law, and puts forward the reform suggestions on the law of legal aid and libel law according to the judicial practice of his own, and so on. These contributions changed the development of English law to a great extent and made English law adapt to and promote the development of modern English society. Although our law belongs to different legal systems with English law, this does not prevent us from absorbing the relevant mature legal systems in England and the progressive legal ideas of western scholars. Lord tannin's legal thought of judicial justice and protection of freedom is worthy of our study, and his specific contribution to the reform of English law after World War II has provided beneficial enlightenment for the improvement of the legal system construction in relevant aspects of our country.
