【摘要】：我國《婚姻法》規(guī)定有效婚姻成立的必經(jīng)途徑是結(jié)婚登記,依法辦理登記并領取結(jié)婚證,合法的夫妻關(guān)系正式成立,而不論雙方同居或舉辦儀式與否。隨著社會經(jīng)濟快速發(fā)展,基于各種動機,呈現(xiàn)出各種情形的婚姻登記程序瑕疵,層出不窮。婚姻登記過程當中會出現(xiàn)各種瑕疵,婚姻效力是不是會受影響,該怎樣認定。我國的《婚姻法》司法解釋(三)第一條對婚姻登記程序瑕疵處理途徑有規(guī)定,但是我國法律對此都沒有做出明確、可操作性的的規(guī)定,仍然存在很多的問題。甚至對于相同或相似案件,可能會出現(xiàn)不同的判決�；橐龅怯洺绦蜩Υ�,不僅事關(guān)婚姻當事人、利益第三人的人身與財產(chǎn)利益,還與司法權(quán)威的確定和立法空白的彌補息息相關(guān)。因而重視登記程序瑕疵婚姻的法律問題探究,處理好其民事處理途徑與行政處理途徑至關(guān)重要。本文的討論對象是婚姻登記程序瑕疵的相關(guān)的法律問題,主要是圍繞著兩個問題進行分析闡述的,一是婚姻登記程序瑕疵的解決路徑即行政路徑與民事路徑的抉擇;二是瑕疵登記婚姻的法律效力如何認定。亮點在于,通過表格的形式列舉出最近司法判決中五個典型案分析出登記程序瑕疵婚姻的效力處理途徑的司法現(xiàn)狀,剖析婚姻登記程序瑕疵行政途徑與民事途徑之間路徑抉擇各自的利弊。分析比較婚姻登記程序瑕疵的處理途徑。指出婚姻登記程序瑕疵婚姻效力處理的總體思路,另外,針對婚姻登記程序瑕疵婚姻的幾種典型的類型進行分析。針對實際生活中常見的幾類典型的婚姻登記程序瑕疵認定:由他人代理辦理婚姻登記,認定的要點在于婚姻關(guān)系雙方是否自愿建立婚姻關(guān)系;使用虛偽的證件、證明材料進行婚姻登記;欺詐進行登記結(jié)婚;違反管轄規(guī)定婚姻登記機關(guān)辦理婚姻登記。本文提出處理我國婚姻登記程序瑕疵立法完善建議,設立行政違法補正:補正輕微瑕疵的行政行為;確立婚姻成立與不成立之訴:解決實際存在的事實婚姻等難題;建立懲處制度:責罰擁有婚姻登記程序瑕疵過錯的責任人即婚姻關(guān)系雙方和工作人員;建立婚姻公示制度:充分發(fā)揮群眾婚姻關(guān)系的監(jiān)督作用。
[Abstract]:Our country's Marriage Law stipulates that the necessary way to establish valid marriage is to register the marriage, register and obtain the marriage certificate according to law, and establish the legal relationship between husband and wife, regardless of whether the two parties live together or hold a ceremony or not. With the rapid development of social economy and based on various motives, there are many defects in marriage registration procedure. Marriage registration process will appear a variety of defects, whether the validity of marriage will be affected, how to determine. The Judicial interpretation of the Marriage Law in China (3) Article 1 provides for the ways to deal with defects in marriage registration procedures, but there are still many problems in our country's laws which do not make clear and operable provisions. Even in the same or similar cases, there may be different judgements. The defect of marriage registration procedure is not only related to the personal and property interests of the parties to marriage and the interests of the third party, but also closely related to the determination of judicial authority and the making up of legislative gaps. Therefore, it is very important to pay attention to the legal problems of registration procedure defective marriage and to deal with its civil and administrative approaches. The object of discussion in this paper is the legal problems related to the defects of the marriage registration procedure, which are mainly analyzed and expounded around two problems: the first is the choice of the administrative path and the civil path to resolve the defects of the marriage registration procedure; Second, how to determine the legal effect of defective registration marriage. The bright spot is that, through the form of a table, we list five typical cases in recent judicial decisions and analyze the judicial status quo of the effective ways to deal with the registration procedures for defective marriages. This paper analyzes the advantages and disadvantages of the path choice between the defective administrative and civil ways of marriage registration procedure. This paper analyzes and compares the ways to deal with the defects of marriage registration procedure. This paper points out the general idea of dealing with the validity of defective marriage in the registration procedure of marriage, and analyzes several typical types of defective marriage in the procedure of registration of marriage. In view of the defects of several typical marriage registration procedures that are common in real life, the main points of the determination are whether or not the marriage relationship is voluntarily established between the two parties to the marriage, the use of false documents, the use of false documents, Registration of marriage by proof materials; registration of marriages by fraud; registration of marriages by marriage registration authorities in violation of jurisdiction. This paper puts forward some suggestions on how to perfect the legislation to deal with the defects in the registration procedure of marriage in our country, and establish the administrative illegal correction: to correct the administrative behavior of minor defects, to establish the lawsuit of the establishment and non-establishment of marriage, to solve the problems of actual de facto marriage, and so on. Set up punishment system: punish the person responsible for the fault of marriage registration procedure, that is, both parties to marriage relations and staff; establish marriage publicity system: give full play to the supervision role of mass marriage relationship.
