【摘要】：近些年，婚內(nèi)侵權這一課題在婚姻法領域?qū)儆诒容^熱的題目。研究婚內(nèi)侵權的學者較多，一開始，大家都在討論婚內(nèi)侵權制度是否需要建立起來�？隙ㄕf與否定說各執(zhí)一詞，針鋒相對。但是到了目前，肯定說已占據(jù)優(yōu)勢，否定說已然勢微。但建立婚內(nèi)侵權制度的關鍵問題是，婚內(nèi)侵權中的“權”的外延有多大，以及在形形色色的權利中，它們的侵權構成是否會有不同。筆者針對這些問題，對婚內(nèi)侵權作類型化研究，以便于婚內(nèi)侵權制度在具體的司法實踐能被很好地操作，及助于對婚內(nèi)侵權制度的完善。 本文共分為四部分。第一部分，婚內(nèi)侵權概述。主要是對婚內(nèi)侵權的概念作一個全新的解讀，然后對婚內(nèi)侵權的性質(zhì)進行分析，與一般侵權的性質(zhì)作對比分析，以進一步地了解和掌握婚內(nèi)侵權。 第二部分，婚內(nèi)侵權之立法現(xiàn)狀�；谀壳拔覈o婚內(nèi)侵權的法律規(guī)定，筆者先介紹世界各地其它國家的相關法律規(guī)定，，再對我國與此相關的法律作詳細闡述，對比分析，找出我國的立法差距。 第三部分，婚內(nèi)侵權相關理論及分析。這部分主要介紹婚內(nèi)侵權制度是否要建立的兩種觀點。一為否定觀點，一為肯定觀點。通過對兩種觀點的詳細介紹分析，得出盡量合乎現(xiàn)代社會需要的觀點。筆者認為應該建立婚內(nèi)侵權制度。 第四部分，婚內(nèi)侵權類型化研析。此部分為本文的核心內(nèi)容。筆者從婚內(nèi)權利入手，先將婚內(nèi)權利作分類，然后根據(jù)各類權利，對其侵權構成、侵權形態(tài)，以及其比較特殊的地方做深入分析。借此，推動婚內(nèi)侵權制度理論的深入研究，以及為以后的立法及司法實踐提供可操作性的理論依據(jù)。
[Abstract]:In recent years, the subject of marital tort is a hot topic in the field of marriage law. There are many scholars studying marital tort. At the beginning, everyone is discussing whether it is necessary to establish the marital tort system. Affirmation and negation are adamant and tit-for-tat. But at present, the affirmation has already occupied the superiority, the negation says already the potential is weak. However, the key problem in establishing the marital tort system is how much the extension of the "right" in the marital tort is, and whether their tort constitution will be different in all kinds of rights. Aiming at these problems, the author makes a study on the classification of marital tort, so that the marital tort system can be well operated in the specific judicial practice, and help to improve the marital tort system. This paper is divided into four parts. The first part is an overview of marital tort. It mainly makes a new interpretation of the concept of marital tort, then analyzes the nature of marital tort, and makes a comparative analysis with the general nature of tort, in order to further understand and master the marital tort. The second part, the legislative status of marital tort. Based on the present legal provisions of non-marital tort in China, the author first introduces the relevant laws and regulations of other countries around the world, and then makes a detailed elaboration of the relevant laws of our country, compares and analyzes to find out the legislative gap in our country. The third part, the theory and analysis of marital tort. This part mainly introduces the two views whether the marital tort system should be established. One is a negative point of view, the other is a positive point of view. Through the detailed introduction and analysis of the two viewpoints, a viewpoint that meets the needs of the modern society as far as possible is obtained. The author believes that the system of marital tort should be established. The fourth part is about the classification of marital tort. This part is the core of this article. The author starts with the marital rights, classifies the marital rights first, and then, according to various rights, makes an in-depth analysis of the constitution, the form and the special place of the infringement. In order to promote the further study of the theory of marital tort system, and to provide an operational theoretical basis for future legislation and judicial practice.
