【摘要】：家庭作為一種特殊的社會組織,曾在人類歷史上扮演著舉足輕重的角色。而在我國歷史上,從封建時代開始直至清末變法,家庭就長期在法律上占據(jù)著主體的地位。然而在現(xiàn)今立法上,我國并未賦予家庭民事主體地位,學界也只有少數(shù)學者對于家庭成為法律主體持樂觀、肯定的態(tài)度,并從一些角度進行論證。但是這些學者的研究大多還停留在賦予家庭以民事主體地位的必要性和可行性上,對與其相關的一些具體問題還缺乏一定的研究。因此在本文中,筆者采用了比較分析法、價值分析法等研究方法,試以歷史演變?yōu)槊}絡,結合當時的社會環(huán)境與政治背景,對家庭的地位進行梳理與分析,并在此基礎上以民事主體理論為支撐,結合現(xiàn)實對其民事主體地位進行未來立法取向分析。除引言外,論文正文分七個部分。 引言部分介紹了家庭的民事主體地位研究這一選題背景和選題價值以及目前國內(nèi)有關家庭的民事主體地位研究的一些現(xiàn)狀。 第一部分：家庭的基本含義及其特點。本部分考察了家庭在歷史上及現(xiàn)代的基本含義,并分析了家庭的基本特征。在我國傳統(tǒng)文化中家庭有多種不同的含義,狹義的家庭指共同維持家計的親屬生活共同體。家庭是二人以上的親屬組成的團體,是以永久共同生活為目的團體,以同居共財為其特點。 第二部分：家庭的起源。本部分簡要闡述了家庭的基礎——婚姻,以及家庭與婚姻的關系,并在此基礎上論述了家庭所經(jīng)歷的四個發(fā)展階段。分別是血緣家庭、普那路亞家庭、對偶制家庭和專偶制家庭。 第三部分：家庭主體地位的歷史演變。本部分通過從家庭主體地位的確立到衰落與喪失的過程闡述,分析了家庭主體地位衰落與喪失的原因。證明家庭主體地位已經(jīng)喪失主要是由于商品經(jīng)濟的發(fā)展,資產(chǎn)階級革命頻發(fā),進而個人人格獨立導致。 第四部分：我國現(xiàn)行民事立法中關于家庭的規(guī)定。本部分主要闡述了在我國現(xiàn)行的《婚姻法》、《民法通則》、《民通意見》中有關家庭的規(guī)定。得出家庭在我國民事立法中不再作為主體出現(xiàn),而僅是親屬共同生活團體的結論。 第五部分：家庭作為民事主體的必要性和可能性。本部分通過分析家庭自身需要以及社會現(xiàn)實的種種需要,得出了家庭需要且可以成為民事主體的結論。 第六部分：確立家庭民事主體地位的理論依據(jù)。本部分先分析了民事主體的判斷標準,進而考察了家庭是否符合這一標準,從而得出了家庭具備民事主體的一般構成要件的結論。 第七部分：確立家庭民事主體地位的制度構建。這部分是文章的核心,因為即使賦予家庭以民事主體地位符合現(xiàn)實的需要,仍要對與其相關的一些具體問題進行研究,這是確立家庭民事主體的獨立地位所不可回避的。本文通過分析家庭與家庭成員之間的法律沖突與解決以及賦予家庭主體地位后與其他民事主體的沖突與協(xié)調(diào),來構建家庭的民事主體制度。
[Abstract]:As a special social organization, the family played an important role in the history of mankind. In the history of China, from the beginning of the feudal era to the late Qing Dynasty, the family has been in the legal position for a long time. However, in the present legislation, our country has not given the status of the civil subject of the family, and the academic circles only have few mathematics. The author holds an optimistic and affirmative attitude towards the family as the subject of law and argues from some angles. However, most of these scholars still remain in the necessity and feasibility of endowing the family as a civil subject, and lack certain research on some specific problems related to them. The method of analysis, value analysis and other research methods, try to analyze the status of the family in the context of the social and political background, and on this basis, on this basis, take the civil subject theory as the support, and combine the reality to analyze the future legislative orientation of its civil subject status. Besides the introduction, the text is divided into seven. Part.
The introduction introduces the background and value of the topic of the study of the subject status of the family, as well as the current status of the domestic research on the civil subject status of the family.
The first part is the basic meaning and characteristics of the family. This part examines the basic meaning of the family in history and modernity, and analyzes the basic characteristics of the family. In the traditional culture of China, the family has many different meanings, and the narrow family refers to the family living community of the family together. The family is composed of more than two relatives. A group is a group that aims to live together for a long time.
The second part: the origin of the family. This section briefly describes the basis of the family, marriage, and the relationship between family and marriage, and on this basis expounds the four stages of development of the family, namely, the consanguineous family, the Perna family, the dual family and the special family.
The third part: the historical evolution of the status of the family subject. This part analyzes the decline and loss of the family subject status through the establishment of the status of the family subject to the process of decline and loss. It is proved that the main status of the family has been lost mainly due to the development of the commodity economy, the frequent bourgeois revolution and the individual personality alone. Erect leads.
The fourth part: the provisions concerning the family in the current civil legislation of our country. This part mainly expounds the provisions concerning the family in the current law of marriage, the general rule of the civil law, the opinions of the civil law, and the conclusion that the family is no longer the main body in the civil legislation of our country, but only the common living group of the relatives.
The fifth part: the necessity and possibility of the family as a civil subject. Through the analysis of the needs of the family and the social reality, this part draws the conclusion that the family needs and can be a civil subject.
The sixth part: the theoretical basis for establishing the status of the civil subject of the family. This part first analyzes the judgment standard of the civil subject, and then examines whether the family conforms to this standard, and thus draws the conclusion of the general constitutive requirements of the civil subject of the family.
The seventh part: establishing the system of the civil subject status of the family. This part is the core of the article, because even if the family is given the actual needs of the civil subject position, it is still necessary to study some specific problems related to it, which is unavoidable to establish the independent status of the civil subject of the family. This article through the analysis of the family. The civil subject system of the family is constructed by the conflict and coordination with the family members, and the conflict and coordination with other civil subjects after the family's main position.
