【摘要】：社會排擠(social exclusion)理論,起源于20世紀初期,是對貧困(poverty)、剝奪(dep-rivation)和劣勢(disadvan-tagcd)的探討。隨著社會排擠的理論研究與實證研究的深入,中外學者也開始將社會性別分析理論引入社會排擠研究范疇。在社會排擠的背景下,女性財產權益日趨弱化,進而引發(fā)女性在婚姻范疇內財產權益的弱化。具體表現是:婚姻時態(tài)下家務貢獻的貶值;離婚時態(tài)下財產權益的流失。為救濟女性的婚姻財產權益,必須關注性別平等與公平正義。
[Abstract]:The theory of social exclusion, originated in the early 20th century, is a study of poverty and poverty deprivation (dep-rivation) and disadvantage (disadvan-tagcd). With the deepening of theoretical and empirical research on social exclusion, Chinese and foreign scholars began to introduce the theory of social gender analysis into the category of social exclusion. In the background of social exclusion, women's property rights and interests are weakening, which leads to the weakening of women's property rights and interests in marriage. The concrete performance is: the devaluation of domestic contribution in marriage and the loss of property rights and interests in divorce. In order to help women's marital property rights and interests, we must pay attention to gender equality and fairness and justice.
