【摘要】：在民法典中,婚姻家庭法律制度最具倫理屬性、民族特性和人文主義精神,與國(guó)家發(fā)展、社會(huì)進(jìn)步密切相關(guān)。從"單行法"到"法典法",婚姻家庭編應(yīng)當(dāng)堅(jiān)持社會(huì)主義婚姻家庭制度的價(jià)值取向與基本原則,保持其相對(duì)獨(dú)立的身份法特點(diǎn)。制定婚姻家庭編既是編纂民法典的需要,也是回應(yīng)社會(huì)發(fā)展所面臨的新問(wèn)題以及完善婚姻家庭法律制度的需要�；橐黾彝ゾ幜⒎☉�(yīng)當(dāng)考慮我國(guó)的立法傳統(tǒng)、基本原則在婚姻家庭編中的作用以及當(dāng)代國(guó)際婚姻家庭立法的發(fā)展趨勢(shì),重構(gòu)婚姻家庭編的基本原則;應(yīng)當(dāng)考慮非婚同居關(guān)系在社會(huì)中逐漸被公眾接受并成為一種生活模式的現(xiàn)實(shí),對(duì)非婚同居關(guān)系作出原則性規(guī)定,以保護(hù)當(dāng)事人特別是未成年子女的合法權(quán)利;應(yīng)當(dāng)認(rèn)真對(duì)待我國(guó)離婚率不斷上升、輕率離婚屢見(jiàn)不鮮、離婚救濟(jì)制度適用受限的問(wèn)題,在保障離婚自由的同時(shí),為防止輕率離婚,實(shí)現(xiàn)法律的公平正義作出理性的制度安排。
[Abstract]:In the Civil Code, the legal system of marriage and family has the most ethical attribute, national character and humanism spirit, which is closely related to national development and social progress. From "single execution Law" to "Code Law", marriage and family compilation should adhere to the value orientation and basic principles of socialist marriage and family system, and maintain its relatively independent identity law characteristics. Making marriage and family compilation is not only the need of compiling civil code, but also responding to the new problems faced by social development and the need to perfect the legal system of marriage and family. The legislation of marriage and family should consider the legislative tradition of our country, the function of basic principles in marriage and family compilation, the development trend of contemporary international marriage and family legislation, and the reconstruction of basic principles of marriage and family compilation. We should consider the fact that non-marital cohabitation relationship is gradually accepted by the public and become a kind of life mode in the society, and make the principle stipulation to the non-marital cohabitation relationship in order to protect the legal rights of the parties, especially the minor children; The divorce rate of our country should be taken seriously, the rate of divorce is rising constantly, it is common to divorce lightly, and the system of divorce relief is limited. While protecting the freedom of divorce, we should make rational system arrangement to prevent the reckless divorce and realize the fairness and justice of the law at the same time.
