當(dāng)代中國(guó)民法中的人文關(guān)懷思想研究

【摘要】:人文關(guān)懷體現(xiàn)在對(duì)現(xiàn)實(shí)的人的物質(zhì)性和精神性生存與發(fā)展的深切關(guān)懷上,表現(xiàn)為對(duì)現(xiàn)實(shí)人的自由和尊嚴(yán)的保障,對(duì)社會(huì)弱勢(shì)群體的關(guān)愛(ài)。本文以馬克思主義人文關(guān)懷思想為指導(dǎo),在充分解讀我國(guó)民法通則、物權(quán)法、侵權(quán)責(zé)任法、婚姻法等民法法律文本的基礎(chǔ)上,指出我國(guó)民法所體現(xiàn)的人文關(guān)懷思想。論文第一部分,主要介紹國(guó)內(nèi)外研究現(xiàn)狀以及研究的背景、意義、方法,并概括了本文的主要研究?jī)?nèi)容和創(chuàng)新點(diǎn)。第二部分,解讀馬克思主義人文關(guān)懷理論。通過(guò)對(duì)中西方人文主義傳統(tǒng)思想的對(duì)比,并在研讀馬克思主義經(jīng)典著作和人文關(guān)懷現(xiàn)有研究成果的基礎(chǔ)之上,總結(jié)馬克思主義人文關(guān)懷的科學(xué)內(nèi)涵,指出馬克思主義人文關(guān)懷思想是物質(zhì)關(guān)懷和精神關(guān)懷、現(xiàn)實(shí)關(guān)懷與終極關(guān)懷的統(tǒng)一。第三部分,分析在當(dāng)代中國(guó)民法制度的建設(shè)中倡導(dǎo)人文關(guān)懷的現(xiàn)實(shí)基礎(chǔ)和理論依據(jù)。提出人文關(guān)懷之所以在當(dāng)代社會(huì)越來(lái)越凸顯,一方面是因?yàn)樗默F(xiàn)實(shí)可行性,對(duì)現(xiàn)實(shí)社會(huì)要求物質(zhì)的滿(mǎn)足和精神的需求的回應(yīng);另一方面是因?yàn)槿宋年P(guān)懷內(nèi)在的科學(xué)性,關(guān)于解決現(xiàn)實(shí)問(wèn)題和構(gòu)架理想社會(huì)符合現(xiàn)代社會(huì)發(fā)展的需要。然后從當(dāng)代中國(guó)社會(huì)主義建設(shè)實(shí)際出發(fā),分析倡導(dǎo)人文關(guān)懷符合構(gòu)建法治國(guó)家的需要。第四部分,分析我國(guó)民法的制度發(fā)展和基本理念。梳理民法的概念,追溯建國(guó)以后我國(guó)民法建設(shè)的發(fā)展歷程,解讀民法的基本理念,即私權(quán)神圣、人格平等和私法自治。第五部分,對(duì)民法中的人文關(guān)懷思想進(jìn)行分析。論述我國(guó)民法的價(jià)值追求,以及其所彰顯的人文關(guān)懷思想——以人的利益為價(jià)值取向,重視人格權(quán)制度的發(fā)展,關(guān)懷弱勢(shì)群體,以及人的主體地位得到逐步確立。第六部分,從人文關(guān)懷視角對(duì)我國(guó)民法制度進(jìn)行應(yīng)然性分析,明確我國(guó)民法制度的構(gòu)建缺乏人文精神的法律傳統(tǒng),因而要重視培養(yǎng)公民對(duì)法律的信仰,以產(chǎn)生構(gòu)建法治社會(huì)的人文土壤;此外,在社會(huì)發(fā)展的新形勢(shì)下,法律條文在規(guī)則和價(jià)值尺度上的沖突和漏洞,以及對(duì)人格權(quán)的保護(hù)所面臨的新挑戰(zhàn),需要盡快實(shí)現(xiàn)民法的法典化,以弘揚(yáng)自由與秩序的統(tǒng)一,實(shí)現(xiàn)價(jià)值與規(guī)則的和諧。
[Abstract]:Humanistic care is embodied in the deep concern for the materiality and spiritual survival and development of realistic human beings, which is manifested in the guarantee of freedom and dignity of realistic human beings and the care for the disadvantaged groups of society.Under the guidance of Marxist humanistic solicitude, on the basis of fully interpreting the legal texts of civil law, such as general principles of civil law, property law, tort liability law and marriage law, this paper points out the humanistic care thought embodied in Chinese civil law.The first part of the paper mainly introduces the research situation at home and abroad as well as the background significance and method of the research and summarizes the main research contents and innovation points of this paper.The second part, the interpretation of Marxist humanistic care theory.By comparing the traditional thoughts of humanism between China and the West, and on the basis of studying the classical works of Marxism and the existing research results of humanistic care, the scientific connotation of humanistic care of Marxism is summarized.It is pointed out that Marxist humanistic care is the unity of material care and spiritual care, between realistic care and ultimate concern.The third part analyzes the realistic basis and theoretical basis of advocating humanistic care in the construction of civil law system in contemporary China.It is put forward that humanistic care is becoming more and more prominent in contemporary society, on the one hand, because of its practical feasibility, and because of its response to the material and spiritual needs of the realistic society; on the other hand, it is because of the inherent scientific nature of humanistic care.Solving practical problems and constructing an ideal society meet the needs of the development of modern society.Then, starting from the reality of socialist construction in contemporary China, the author analyzes that advocating humanistic care meets the needs of building a country ruled by law.The fourth part, analyzes the system development and the basic idea of our country civil law.Combing the concept of civil law, tracing back to the development of civil law construction after the founding of the people's Republic of China, and interpreting the basic concepts of civil law, namely, the sacredness of private rights, equality of personality and autonomy of private law.The fifth part, carries on the analysis to the humanity concern thought in the civil law.This paper discusses the value pursuit of the civil law in China, and its humanism concern thought, which takes the human interests as the value orientation, attaches importance to the development of the personality right system, cares for the vulnerable groups, and the subject status of the human being is gradually established.The sixth part, from the angle of humanistic concern, analyzes the necessity of the civil law system of our country, and clarifies that the construction of the civil law system in our country lacks the legal tradition of humanism spirit, so we should pay attention to the cultivation of citizens' belief in the law.In addition, under the new situation of social development, the conflicts and loopholes in the rules and value scales of legal texts, as well as the new challenges to the protection of personality rights, are created to create a humanistic soil for the construction of a society governed by the rule of law.It is necessary to realize the codification of civil law as soon as possible in order to promote the unity of freedom and order and to realize the harmony of value and rule.
