【摘要】：通過(guò)調(diào)研發(fā)現(xiàn),被調(diào)研法院在司法實(shí)踐中貫徹男女平等原則進(jìn)行離婚財(cái)產(chǎn)清算,減輕女方清償夫妻共同債務(wù)責(zé)任,維護(hù)離婚婦女財(cái)產(chǎn)權(quán)取得成效。但司法實(shí)踐中也存在某些問(wèn)題,法院判決夫妻共同財(cái)產(chǎn)分割時(shí)較少適用照顧女方權(quán)益原則,在共同財(cái)產(chǎn)分割中女方獲得的財(cái)產(chǎn)數(shù)量少,女方放棄嫁妝或其他個(gè)人財(cái)產(chǎn)數(shù)量較多,法官認(rèn)定夫妻共同債務(wù)適用標(biāo)準(zhǔn)有差異,部分法官對(duì)離婚協(xié)議內(nèi)容實(shí)質(zhì)審查不充分,部分法官缺乏社會(huì)性別意識(shí)等情況。在對(duì)現(xiàn)行立法與司法檢視的基礎(chǔ)上,提出如下對(duì)策建議:明確適用照顧女方原則的司法意見(jiàn),確立婚前個(gè)人財(cái)產(chǎn)婚后自然損耗補(bǔ)償制度,設(shè)立夫妻日常家事代理制度解決夫妻共同債務(wù)認(rèn)定的困境,增設(shè)法院家事調(diào)解顧問(wèn),加強(qiáng)法官社會(huì)性別意識(shí)專門(mén)培訓(xùn)等,從實(shí)體與程序上建立維護(hù)離婚婦女財(cái)產(chǎn)權(quán)益的法律保障體系。
[Abstract]:Through investigation, it is found that in judicial practice, the investigated court carries out the liquidation of divorce property according to the principle of equality between men and women, so as to lighten the woman's liability to pay off the couple's common debts. However, there are still some problems in judicial practice. The court has ruled that the principle of taking care of the rights and interests of women is seldom applied in the division of common property between husband and wife, and the amount of property acquired by women in the division of common property is small. The woman gave up the dowry or other personal property in a large number, the judge found that there were differences in the applicable criteria for the couple's joint debt, and some judges did not adequately examine the substance of the divorce agreement. On the basis of examining the current legislation and judicature, some judges have put forward the following countermeasures and suggestions: make clear the judicial opinions on the principle of taking care of women, and establish the compensation system of natural loss after marriage of personal property before marriage. To set up a daily family affairs agency system to solve the difficulties of joint debt identification, to increase the number of family mediation counsellors in court, to strengthen the specialized training of judges in gender awareness, etc. Establish a legal protection system to safeguard the property rights and interests of divorced women from the substantive and procedural aspects.
