【摘要】： 罪犯雖然是我們社會(huì)的失足者,但是其各項(xiàng)權(quán)利的保護(hù)卻有著十分重要的意義,這不僅是一個(gè)國家尊重與保障人權(quán)的重要方面,更是法治與理念進(jìn)步的標(biāo)志。這其中,罪犯生育權(quán)是一個(gè)值得我們關(guān)注研究的問題。 生育權(quán)作為一種基本人權(quán),監(jiān)獄罪犯也應(yīng)當(dāng)享有。確立監(jiān)獄罪犯的生育權(quán),有利于罪犯的教育改造,協(xié)調(diào)好自由與秩序的關(guān)系,也有利于人權(quán)保障和刑罰執(zhí)行目的的實(shí)現(xiàn)。 監(jiān)獄罪犯作為特殊群體,人身自由受到限制,實(shí)際上很難如普通公民一樣行使此種權(quán)利。在尋求罪犯生育權(quán)利與監(jiān)獄管理的平衡點(diǎn)的基礎(chǔ)上實(shí)現(xiàn)對(duì)罪犯生育有選擇、有條件、有差別、有目的的保護(hù)。
[Abstract]:Although criminals are missteps in our society, the protection of their rights is of great significance. This is not only an important aspect of a country's respect for and protection of human rights, but also a symbol of the progress of the rule of law and ideas. The reproductive right of criminals is a problem worthy of our attention. As a basic human right, prison criminals should enjoy their reproductive rights, which is conducive to the education and reform of criminals, the coordination of the relationship between freedom and order, and the realization of human rights protection and the implementation of punishment. Prison criminals, as a special group, are subject to restrictions on their personal freedom, and it is difficult, in practice, to exercise such rights as ordinary citizens... to achieve choice and conditions for the reproduction of prisoners on the basis of seeking a balance between the reproductive rights of offenders and prison administration, Differential, purposeful protection.
