【摘要】：近年來(lái),棄嬰問題尤為凸出,這給我國(guó)經(jīng)濟(jì)、社會(huì)的發(fā)展帶來(lái)了巨大且深遠(yuǎn)的影響。妥善解決棄嬰問題在現(xiàn)實(shí)社會(huì)中的重要性日益凸顯出來(lái),而就目前我國(guó)現(xiàn)有的相關(guān)法律而言,在解決棄嬰問題方面還有很多不足,面對(duì)棄嬰問題不斷的加劇,加強(qiáng)對(duì)棄嬰權(quán)益的保障,完善我國(guó)棄嬰收養(yǎng)制度的立法已經(jīng)迫在眉睫。本文旨在從保護(hù)棄嬰權(quán)益角度出發(fā),對(duì)我國(guó)棄嬰收養(yǎng)制度立法有關(guān)問題進(jìn)行探討。本文以“我國(guó)棄嬰收養(yǎng)制度之立法研究”為題進(jìn)行研究,一共由四個(gè)部分組成。第一部分為我國(guó)棄嬰收養(yǎng)制度概述。主要闡述了我國(guó)棄嬰產(chǎn)生原因、棄嬰收養(yǎng)的概念和特征、棄嬰收養(yǎng)的原則、棄嬰收養(yǎng)法律關(guān)系構(gòu)成要素四個(gè)方面進(jìn)行闡述。第二部分為我國(guó)棄嬰收養(yǎng)制度立法存在的不足。此部分為論文的重點(diǎn)部分,主要從收養(yǎng)人條件的規(guī)定、棄嬰收養(yǎng)的審查方式、可撤銷收養(yǎng)行為、試收養(yǎng)期制度、保密條款、棄嬰收養(yǎng)關(guān)系成立后的監(jiān)督六個(gè)方面闡述了目前我國(guó)棄嬰收養(yǎng)制度立法上存在的不足。第三部分為部分國(guó)家收養(yǎng)制度立法狀況及啟示。主要介紹了德國(guó)、英國(guó)、美國(guó)關(guān)于棄嬰收養(yǎng)制度的立法,并歸納出這三個(gè)國(guó)家棄嬰收養(yǎng)制度的啟示,對(duì)今后完善我國(guó)棄嬰收養(yǎng)制度有一定借鑒作用。第四部分為我國(guó)棄嬰收養(yǎng)制度的立法完善。此部分為論文最重要的部分,首先,從尊重和保障人權(quán)、棄嬰合法權(quán)益保護(hù)、棄嬰在完整的家庭中健康成長(zhǎng)、維護(hù)收養(yǎng)法律權(quán)威性及公正性、應(yīng)對(duì)棄嬰收養(yǎng)問題嚴(yán)峻性等五個(gè)方面論述了我國(guó)棄嬰收養(yǎng)制度立法完善的必要性。其次,從適當(dāng)放寬收養(yǎng)條件、增加對(duì)收養(yǎng)人實(shí)質(zhì)審查的規(guī)定、增設(shè)可撤銷收養(yǎng)行為、確立棄嬰試收養(yǎng)期制度、完善棄嬰收養(yǎng)中的保密制度、建立對(duì)棄嬰收養(yǎng)關(guān)系成立后的監(jiān)督制度等六個(gè)方面闡述了如何完善我國(guó)棄嬰收養(yǎng)制度的立法。
[Abstract]:In recent years, the problem of abandoned baby is especially prominent, which has brought great and far-reaching influence to the development of economy and society of our country. The importance of properly solving the problem of abandoned baby is becoming more and more prominent in the real society. As far as the existing relevant laws in our country are concerned, there are still many deficiencies in solving the problem of abandoned infants. In the face of the worsening of the problem of abandoned infants, we should strengthen the protection of the rights and interests of abandoned infants. It is urgent to perfect the legislation on the adoption of abandoned infants in China. This paper aims to protect the rights and interests of abandoned infants. This paper makes a study on the legislation of abandoned infant adoption system in China, which is entitled "Legislative Research on the system of abandoned Infant Adoption in China". It consists of four parts. The first part is an overview of the system of abandoned infant adoption in China. It mainly expounds the causes of abandonment, the concept and characteristics of abandoned infant adoption, the principles of abandoned infant adoption. The second part is the deficiency of the legislation of abandoned infant adoption system in our country. This part is the key part of the thesis, mainly from the provisions of the adopters' conditions, the review method of abandoned infant adoption. Revocation of adoptions, trial adoption period, confidentiality clauses, Six aspects of supervision after the establishment of foundling adoptive relationship have expounded the deficiencies in the legislation of abandoned infant adoption system in China. The third part is the legislative situation and enlightenment of adoption system in some countries. The legislation of the abandoned infant adoption system in the United States, and the enlightenment of the abandoned infant adoption system in these three countries are summarized. This part is the most important part of the thesis. Firstly, from the respect and protection of human rights, the legal rights and interests of abandoned babies are protected. This paper discusses the necessity of perfecting the legislation of abandoned infant adoption system from five aspects: healthy growth in a complete family, maintaining the authority and impartiality of adoption law, and dealing with the problem of abandoned infant adoption. To increase the provisions on the substantive examination of adopters, to add the act of cancelling adoption, to establish the system of trial adoption of abandoned infants, and to perfect the secrecy system in the adoption of abandoned infants, This paper discusses how to perfect the legislation of abandoned infant adoption system in six aspects, such as establishing supervision system after the establishment of abandoned infant adoption relationship.
