【摘要】： 本學(xué)位論文以構(gòu)建我國的非婚同居法律制度為核心和目的，除了引言和結(jié)語外，主要包括以下方面的研究內(nèi)容： 第一部分，非婚同居概述。該部分共四節(jié)，筆者考察了同居和非婚同居概念的內(nèi)涵和外延，通過分析非婚同居與非法同居、婚姻、無效婚姻、可撤銷婚姻、事實(shí)婚姻等概念之間的關(guān)系，界定了非婚同居的概念和分類，并對現(xiàn)行立法進(jìn)行了梳理和評析； 第二部分，構(gòu)建我國非婚同居法律制度的必要性和可能性。本部分從必要性和可能性這兩個方面對我國構(gòu)建非婚同居法律制度的現(xiàn)實(shí)條件作了詳細(xì)的論證； 第三部分，構(gòu)建我國非婚同居法律制度的理論基礎(chǔ)。在本部分筆者對現(xiàn)有非婚同居的有關(guān)理論依據(jù)進(jìn)行了反思，探討了當(dāng)事人有權(quán)選擇非婚同居的理論依據(jù)，提出將廣義家庭論作為構(gòu)建我國非婚同居法律制度的理論基礎(chǔ)，并闡述了非婚同居法律制度在民事法律制度中的地位，以及在我國構(gòu)建非婚同居法律制度的意義； 第四部分，構(gòu)建我國非婚同居法律制度的具體規(guī)則設(shè)計(jì)。該部分共分四節(jié)，，筆者對非婚同居的成立及解除、非婚同居者之間的人身關(guān)系、非婚同居者之間的財(cái)產(chǎn)關(guān)系以及其他權(quán)利義務(wù)關(guān)系等具體問題提出了相關(guān)法律規(guī)則的設(shè)計(jì)建議。
[Abstract]:This dissertation focuses on the construction of the legal system of non-marital cohabitation in China. In addition to the introduction and conclusion, it mainly includes the following aspects of research:. The first part is an overview of non-marital cohabitation. There are four sections in this part. The author examines the connotation and extension of cohabitation and non-marital cohabitation, through the analysis of non-marital cohabitation and illegal cohabitation, marriage, invalid marriage, revocable marriage, The relationship between the concepts of de facto marriage and other concepts, defines the concept and classification of non-marital cohabitation, and analyzes the current legislation; The second part, the necessity and possibility of constructing the legal system of non-marital cohabitation in our country. This part makes a detailed demonstration on the realistic conditions of constructing the legal system of non-marital cohabitation in China from the two aspects of necessity and possibility; In this part, the author reflects on the existing theoretical basis of non-marital cohabitation, and discusses the theoretical basis of the right of the parties to choose non-marital cohabitation. This paper puts forward the generalized family theory as the theoretical basis of constructing the legal system of non-marital cohabitation in our country, and expounds the position of the legal system of non-marital cohabitation in the civil legal system and the significance of constructing the legal system of non-marital cohabitation in our country. Part 4th, the design of specific rules to construct the legal system of non-marital cohabitation in our country. This part is divided into four sections, the author of the establishment and dissolution of non-marital cohabitation, the personal relationship between non-marital cohabitants, The property relationship and other rights and obligations between non-marital cohabitants are discussed.
