【摘要】：近些年來(lái),隨著社會(huì)的開(kāi)放與發(fā)展,人們的思想在逐漸發(fā)生改變,相應(yīng)的價(jià)值觀、婚姻觀等觀念思想不斷變化,以往“從一而終”傳統(tǒng)思維開(kāi)始被摒棄,我國(guó)婚姻家庭的穩(wěn)定性開(kāi)始受到影響,“離婚”在我們的生活中已趨于普通化,并有逐年上升之勢(shì)。基于筆者的職業(yè)性,實(shí)務(wù)中在離婚案件的審理過(guò)程中,該類(lèi)訴訟所涉及的問(wèn)題除了感情破裂和子女歸屬問(wèn)題外,財(cái)產(chǎn)分割問(wèn)題成為離婚訴訟中的主要問(wèn)題,而在財(cái)產(chǎn)中的房產(chǎn)如何分割則成為最為復(fù)雜的焦點(diǎn)問(wèn)題,因此離婚訴訟涉及房產(chǎn)分割問(wèn)題成為離婚案件中的大難題,如何理清案件當(dāng)中的法律關(guān)系,關(guān)乎到案件最終判決的準(zhǔn)確性與當(dāng)事人的合法權(quán)益是否得到合理維護(hù),因此,離婚訴訟中的房產(chǎn)糾紛問(wèn)題值得深入研究。本文從司法實(shí)踐中出現(xiàn)的房產(chǎn)糾紛入手,在現(xiàn)有的國(guó)內(nèi)學(xué)者研究成果的基礎(chǔ)上,依據(jù)相關(guān)法律法規(guī),并參考了法院審理婚姻家庭案件觀點(diǎn)集成,采用實(shí)證研究的方法,結(jié)合本地區(qū)筆者所承辦的案件及其他省市案件的審判,分情況對(duì)離婚訴訟中比較常見(jiàn)的幾類(lèi)房產(chǎn)分割糾紛進(jìn)行分析,以期梳理清楚其中的法律關(guān)系。全文包括引言、正文四部分和結(jié)語(yǔ):正文四部分主要通過(guò)對(duì)父母出資購(gòu)買(mǎi)的按揭房、房改房、經(jīng)濟(jì)適用房及拆遷安置房等四種房產(chǎn)類(lèi)型在離婚訴訟中的權(quán)屬認(rèn)定及分割進(jìn)行研究,以上在筆者提供的案例中均有體現(xiàn)。全文共列舉四類(lèi)案例,主要形式為提出分歧意見(jiàn),再找出案件的爭(zhēng)議焦點(diǎn),繼而展開(kāi)對(duì)案件相關(guān)的法律問(wèn)題進(jìn)行深入淺了的分析,最終找出最終解決方法,全文中筆者提出自己的觀點(diǎn),找出正確的結(jié)論,并提出自己的幾點(diǎn)建議與思考。結(jié)語(yǔ)對(duì)全文進(jìn)行了總結(jié)。
[Abstract]:In recent years, with the opening and development of society, people's thinking is gradually changing, the corresponding values, the concept of marriage and other ideas constantly change, the past "from one to the last" traditional thinking began to be abandoned. The stability of marriage and family in our country is beginning to be affected. Divorce has become more and more common in our life, and it has been rising year by year. In addition to the issues of emotional breakdown and child ownership, the division of property has become the main issue in divorce proceedings, and how to divide the property in the property has become the most complex focus. Therefore, the divorce proceedings involving the division of real estate has become a major problem in divorce cases. How to clear up the legal relationship in the case is related to whether the accuracy of the final judgment of the case and the legitimate rights and interests of the parties concerned are reasonably maintained, therefore, The real estate disputes in divorce proceedings are worth further study. This paper starts with the real estate disputes in judicial practice, based on the existing research results of domestic scholars, according to the relevant laws and regulations, And referring to the integration of views of court hearing marriage and family cases, adopting the method of empirical research, combining the cases undertaken by the author of the region and the trials of other provinces and cities, This paper analyzes several kinds of real estate division disputes, which are common in divorce proceedings, in order to sort out the legal relationship among them. The full text includes an introduction. Main body four parts and conclusion: the main body four parts mainly through to the parents to buy the mortgage house, the housing reform, comfortable housing and the demolition resettlement house and so on four kinds of real estate types in the divorce lawsuit confirmation and the division carries on the research. All of the above are reflected in the cases provided by the author. The full text lists four kinds of cases, mainly in the form of putting forward different opinions, finding out the dispute focus of the case, and then carrying out a deep and shallow analysis of the legal issues related to the case. Finally find out the final solution, the author put forward his own point of view, find out the correct conclusion, and put forward his own several suggestions and thinking.
