【摘要】： 日本明治維新以來,日本積極引入西歐各國司法制度,建立了具一定近代性,但總體上并不完整的天皇制司法。戰(zhàn)后,日本繼續(xù)推行司法改革,雖從理念層面和制度層面發(fā)生了深刻變化,但是,由于缺乏陪審制度,民主性質(zhì)弱化,未清算戰(zhàn)前司法,導(dǎo)致司法存在意義上的后退。世紀之交,日本繼續(xù)大力推行司法改革,改變司法裁決時間過長、費用過高的狀態(tài),提高國民對司法的信賴,司法改革與企業(yè)體制、金融體制、行政體制改革互動,作為市場體制的監(jiān)督者,維持市場經(jīng)濟體制整體效率與公平。日本司法改革取得立法階段的重要成果,為保障市場經(jīng)濟體制的運行奠定了制度基礎(chǔ),對我國司法改革有一定的啟發(fā)和借鑒作用。
[Abstract]:Since the Meiji Restoration of Japan, Japan has actively introduced the judicial systems of Western European countries, and has established the imperial justice system, which has a certain modern character, but is not complete in general. After the war, Japan continued to carry out judicial reform. Although profound changes have taken place in terms of concept and system, due to the lack of jury system, the weakening of democratic nature and the non-liquidation of pre-war justice, the judicial existence has retreated. At the turn of the century, Japan continued to vigorously promote judicial reform. To change the state that judicial decisions are too long and the costs are too high, to enhance the trust of the people in the administration of justice, to interact with the reform of the enterprise system, the financial system, and the administrative system, and to act as a supervisor of the market system. To maintain the overall efficiency and fairness of the market economy system, Japan's judicial reform has achieved important achievements in the legislative stage, which has laid the institutional foundation for ensuring the operation of the market economy system, and has a certain enlightening and referential function for the judicial reform of our country.
