【摘要】：我國四法域由于歷史上的各種原因,發(fā)展了各具特色的法律制度。四法域?qū)τ陔x婚損害賠償法律制度的立法和司法實(shí)踐存在著很大的區(qū)別,主要體現(xiàn)在離婚損害賠償?shù)姆ǘɡ碛�、離婚損害賠償?shù)倪m用程序以及離婚損害賠償?shù)臉?biāo)準(zhǔn)方面。文章通過比較大陸、香港、澳門、臺(tái)灣地區(qū)有關(guān)離婚損害賠償?shù)姆梢?guī)定,分析四法域在上述三個(gè)問題上的不同點(diǎn),在借鑒與吸收的基礎(chǔ)上對(duì)大陸地區(qū)離婚損害賠償制度的立法完善提出建議。 文章主要分為六個(gè)部分對(duì)上述問題進(jìn)行闡述。 第一部分為引言,指出文章選題的理論意義和實(shí)用價(jià)值、研究方法、國內(nèi)外的研究現(xiàn)狀等。 第二部分為大陸、香港、澳門、臺(tái)灣地區(qū)四法域離婚損害賠償制度法定理由的比較,主要從離婚損害賠償制度的構(gòu)成要件、離婚損害賠償制度的請(qǐng)求權(quán)主體、離婚損害賠償制度的賠償義務(wù)主體方面進(jìn)行比較。四地區(qū)離婚損害賠償制度的法定理由,在構(gòu)成要件方面的相同點(diǎn)表現(xiàn)在：一方當(dāng)事人均實(shí)施了法定違法情形,存在過錯(cuò)；均造成一定的損害后果；違法行為和損害后果之間具有因果關(guān)系；以離婚的發(fā)生為條件。差異主要體現(xiàn)在：行為人主觀過錯(cuò)內(nèi)容不盡相同,損害的范圍不同。在離婚損害賠償請(qǐng)求權(quán)主體方面,相同點(diǎn)體現(xiàn)在四地區(qū)均規(guī)定婚姻中的“無過錯(cuò)方”為離婚損害賠償?shù)恼?qǐng)求權(quán)主體。區(qū)別在于“無過錯(cuò)方”所指代的內(nèi)容不同,大陸地區(qū)一般指未實(shí)施法定四種過錯(cuò)行為的一方；香港為未實(shí)施通奸行為的一方；澳門為無過錯(cuò)或無主要過錯(cuò)以及精神能力發(fā)生變化逾三年、且因其嚴(yán)重性無法與另一方繼續(xù)生活的一方；臺(tái)灣地區(qū)地區(qū)為受害方,但在主張非財(cái)產(chǎn)性損害時(shí)為無過失方,也即無獨(dú)立的有責(zé)離婚原因的一方。在損害賠償?shù)牧x務(wù)主體方面,相同點(diǎn)表現(xiàn)在四地區(qū)均將“過錯(cuò)方”列為損害賠償?shù)牧x務(wù)主體。區(qū)別在于,大陸、澳門、臺(tái)灣地區(qū)地區(qū)中的“過錯(cuò)方”為夫妻中的一方配偶,而香港地區(qū)則將實(shí)施通奸行為的“第三者”列為離婚損害賠償?shù)牧x務(wù)主體。 第三部分四法域離婚損害賠償適用程序的比較,主要從提起離婚損害賠償?shù)臅r(shí)間、離婚損害賠償?shù)倪m用程序兩個(gè)方面進(jìn)行比較。指出四法域在提起離婚損害賠償?shù)臅r(shí)間方面各有自己的特點(diǎn)。在離婚損害賠償?shù)倪m用程序上,均規(guī)定受害人可以通過訴訟離婚途徑行使離婚損害賠償請(qǐng)求權(quán),維護(hù)自己的合法權(quán)益。但香港地區(qū)受害人只能通過訴訟離婚行使離婚損害賠償請(qǐng)求權(quán),大陸、澳門、臺(tái)灣地區(qū)三地區(qū)的受害人不但可以通過訴訟離婚行使損害賠償請(qǐng)求權(quán),還能夠通過協(xié)議離婚的方式實(shí)現(xiàn)離婚損害賠償請(qǐng)求權(quán)的行使。 第四部分離婚損害賠償標(biāo)準(zhǔn)的比較,指出四地區(qū)都將非財(cái)產(chǎn)損害(精神損害)納入離婚損害賠償?shù)姆秶?但澳門地區(qū)的賠償范圍僅包含非財(cái)產(chǎn)損害一項(xiàng)內(nèi)容,而大陸、香港、臺(tái)灣地區(qū)地區(qū)的賠償范圍包括精神損害與物質(zhì)損害兩項(xiàng)內(nèi)容。同時(shí),四地區(qū)在立法上,均缺乏對(duì)離婚損害賠償數(shù)額的認(rèn)定、確認(rèn)賠償數(shù)額的參考因素以及賠償數(shù)額的支付方式的明確規(guī)定。 第五部分為大陸離婚損害賠償制度的缺陷及立法完善建議,指出根據(jù)分析比較,大陸地區(qū)離婚損害賠償制度仍然存在著請(qǐng)求權(quán)主體限制過于嚴(yán)格、法定過錯(cuò)事由范圍狹窄、損害賠償適用范圍不明確等問題,進(jìn)而借鑒其他三地區(qū)離婚損害賠償制度的優(yōu)點(diǎn),提出放寬請(qǐng)求權(quán)主體、擴(kuò)大過錯(cuò)行為范圍、明確舉證責(zé)任、合理確定賠償數(shù)額等內(nèi)容。 第六部分結(jié)語,指出文章僅以比較分析的方法,對(duì)四法域離婚損害賠償制度的法定理由、適用程序、賠償標(biāo)準(zhǔn)進(jìn)行分析比較,提出完善大陸地區(qū)離婚損害賠償制度的立法建議,尚有許多問題有待解決。
[Abstract]:Due to the historical reasons , China ' s four jurisdictions have developed various legal systems . The four jurisdictions have great differences in the legislation and judicial practice of the legal system of divorce damages , which is mainly embodied in the legal grounds of divorce damages , the application procedure of divorce damages and the standard of divorce damages . The article is divided into six parts to elaborate the above - mentioned problems . The first part is preface , points out the theory meaning and practical value of the article selection , the research method , the research situation at home and abroad , etc . The second part compares the legal grounds of divorce damage compensation system in mainland , Hong Kong , Macao and Taiwan . It is mainly based on the constitutive elements of divorce damage compensation system , the right subject of divorce damage compensation system and the compensation obligation subject of divorce damage compensation system . In the third part , compared with the application procedure of divorce damage compensation in four jurisdictions , the author compares the time of divorce damage compensation and the application procedure of divorce damage compensation . In the fourth part , the author points out that the four areas include non - property damage ( mental impairment ) in the scope of divorce damage compensation , but the compensation scope of the Macao SAR includes only one content of non - property damage , while the compensation range of the mainland , Hong Kong and Taiwan area includes two contents of mental harm and material damage . At the same time , in the four areas , there is a lack of stipulation on the amount of compensation for divorce , the reference factor to confirm the amount of compensation and the payment method of compensation amount . In the fifth part , the author points out the defects of the system of compensation for divorce damages in mainland China , and points out that , according to the analysis , the system of compensation for divorce damages in mainland China still has the problems of too strict limitation , narrow scope of legal fault , unclear scope of application and other problems , and puts forward the content of relaxing the subject of claim , enlarging the scope of fault behavior , clarifying the burden of proof and reasonably determining the amount of compensation . In the sixth part , the author points out that the article compares the statutory reason , the application procedure and the compensation standard of the divorce damage compensation system in four jurisdictions , and puts forward some legislative suggestions to improve the system of divorce damage compensation in mainland China . There are still many problems to be solved .
