商務(wù)合同中的歧義現(xiàn)象及消除方法

歧義在語言交流過程中隨處可見,古今中外各個(gè)語言學(xué)家都對這一現(xiàn)象提出了各自的獨(dú)到的見解。特別是在古希臘,語言學(xué)研究比較發(fā)達(dá)的階段,無論是哲學(xué)家還是語言學(xué)家都提出了相應(yīng)的歧義理論。直到當(dāng)代,尤其被譽(yù)為句法理論奠基人的美國語言學(xué)家Chomsky更把歧義的分析與研究應(yīng)用在實(shí)際的句法構(gòu)成當(dāng)中,使分散的歧義理論更加的系統(tǒng)化。除此之外,在中國誕生出諸如趙元任、邱述德、朱德熙等研究這一理論的許多語言學(xué)家,在他們的努力下,歧義理論走出了英語這一單一語言范疇,進(jìn)入了漢語語言結(jié)構(gòu)的分析,無疑是一個(gè)偉大的創(chuàng)舉。特別是近年來,歧義研究理論的興起與應(yīng)用正以新的視角如火如荼的展開,涉及的領(lǐng)域已經(jīng)走出了純語言的環(huán)境。文化、經(jīng)濟(jì),以及科技等諸多方面都有歧義的應(yīng)用實(shí)例。本文以語用學(xué)中各個(gè)語言學(xué)家提出的不同的歧義理論來分析研究商務(wù)合同寫作過程中產(chǎn)生的歧義現(xiàn)象,旨在通過若干實(shí)例的定性分析,來揭示歧義這一語言現(xiàn)象,同時(shí),就這一語言現(xiàn)象提出若干的消除方法。因此,立足于這一理論,本文首先從語言學(xué)的角度剖析產(chǎn)生歧義的背景和原因;其次,分析合同這一特殊的契約工具的文體特點(diǎn)及歷史作用;以上述兩大理論依據(jù),研究合同撰寫過程中會(huì)出現(xiàn)哪些歧義...
