論勞務(wù)派遣人員權(quán)益保護(hù)

【摘要】:勞務(wù)派遣作為一種典型的特殊雇傭勞動形式,在我國的發(fā)展歷史并不長。2008年《勞動合同法》中用法律形式將其合法化后,勞務(wù)派遣就因其靈活的用工方式、降低企業(yè)用工成本、減少企業(yè)勞動爭議敗訴風(fēng)險等特點,受到大量企業(yè)的青睞,出現(xiàn)蓬勃發(fā)展的趨勢,并對我國嚴(yán)峻的就業(yè)壓力起到緩解作用。但近幾年來,由于許多企業(yè)濫用勞務(wù)派遣用工方式,加之《勞動合同法》及《勞動合同法實施條例》中的規(guī)定在實踐中操作性不強(qiáng),造成勞務(wù)派遣用工方式中存在諸多問題,例如勞務(wù)派遣人員同工不同酬、社保權(quán)益受損、用工單位使用勞務(wù)派遣人員超出三性崗位、勞務(wù)派遣機(jī)構(gòu)資質(zhì)偏低等,致使勞務(wù)派遣人員的合法權(quán)益被嚴(yán)重侵害,己背離了勞動合同法規(guī)范勞務(wù)派遣用工的立法初衷。2012年12月28日全國人大常委會通過了關(guān)于修改勞動合同法的決定,修改后的勞動合同法將于2013年7月1日起正式實施。盡管此次修改提高了勞務(wù)派遣機(jī)構(gòu)的準(zhǔn)入門檻,對經(jīng)營勞務(wù)派遣業(yè)務(wù)實施行政許可,對三性崗位、同工同酬均作出了說明,并且加大了對違法行為的處罰力度,但是對目前實務(wù)操作中涉及勞務(wù)派遣人員社會保險繳費額偏低、主體不適格的勞務(wù)派遣以及退回機(jī)制中存在的侵害勞務(wù)派遣人員合法權(quán)益問題仍然較為突出,亟待解決。本文主要從實務(wù)角度出發(fā),運用歸納、比較分析的方法,結(jié)合《勞動合同法》中相關(guān)規(guī)定及典型案例,從介紹我國勞務(wù)派遣基本情況著手,對目前我國勞務(wù)派遣中存在的勞務(wù)派遣機(jī)構(gòu)通過異地派遣降低社會保險繳費費率致使勞務(wù)派遣工社保權(quán)益受損,非正規(guī)就業(yè)組織的勞務(wù)派遣造成勞務(wù)派遣人員維權(quán)困境,以及退回機(jī)制中對勞務(wù)派遣人員權(quán)益侵害的問題進(jìn)行探討,提出勞動者權(quán)益保護(hù)方面的實踐情況和法律問題,為勞務(wù)派遣制度的發(fā)展和完善,切實保護(hù)勞務(wù)派遣人員合法權(quán)益提出相應(yīng)建議,對構(gòu)建和諧勞動關(guān)系,維護(hù)社會穩(wěn)定具有指導(dǎo)意義。具體來說,本文的結(jié)構(gòu)主要分為以下四個部分:第一部分,我國勞務(wù)派遣發(fā)展基本情況。該部分主要是針對我國勞務(wù)派遣的定義、特征、興起原因、發(fā)展歷程和現(xiàn)狀進(jìn)行介紹,從而引出目前我國勞務(wù)派遣中存在的問題。第二部分,異地派遣對勞務(wù)派遣人員社保權(quán)益侵害,結(jié)合典型案例分析異地派遣興起的原因,及異地派遣的勞務(wù)派遣人員維權(quán)困境,并提出建議。第三部分,非正規(guī)就業(yè)組織對勞務(wù)派遣人員權(quán)益侵害問題。該部分主要通過介紹該組織產(chǎn)生的原因,性質(zhì)及發(fā)展現(xiàn)狀,結(jié)合案例分析該組織中勞務(wù)派遣人員權(quán)益保護(hù)缺失的原因,并提出如何解決該困境。第四部分,退回機(jī)制對勞務(wù)派遣人員權(quán)益侵害問題。該部分主要從《勞動合同法》勞務(wù)派遣專章中對勞務(wù)派遣人員可以被退回的規(guī)定入手,結(jié)合典型案例,分析退回產(chǎn)生的原因,及被退回勞動者維權(quán)困境,并提出建議。
[Abstract]:As a typical special form of wage labor, the development history of labor dispatch in our country is not long. After legalizing it in the labor contract law in 2008, labor dispatch has been favored by a large number of enterprises because of its flexible employment mode, reducing the cost of employment and reducing the risk of losing labor disputes, which is favored by a large number of enterprises, showing a vigorous development trend, and plays a role in alleviating the severe employment pressure in our country. However, in recent years, due to the abuse of labor dispatch employment mode by many enterprises, coupled with the fact that the provisions of the Labor contract Law and the regulations on the implementation of Labor contract Law are not strong in practice, there are many problems in the employment mode of labor dispatch, such as unequal pay for equal work for labor dispatch personnel, damage to social security rights and interests, employment units using labor dispatch personnel to exceed three-sex posts, and low qualifications of labor dispatch agencies, and so on. As a result, the legitimate rights and interests of labor dispatch personnel have been seriously infringed, which has deviated from the original legislative intention of labor contract law regulating labor dispatch employment. On December 28, 2012, the standing Committee of the National people's Congress adopted a decision on amending labor contract law, and the revised labor contract law will be formally implemented on July 1, 2013. Although this revision has raised the entry threshold for labor dispatch institutions, implemented administrative permits for operating labor dispatch business, explained the three jobs and equal pay for equal work, and increased the punishment for illegal acts, the amount of social insurance contributions involving labor dispatch personnel in the current practical operation is on the low side. The problem of infringing the legitimate rights and interests of labor dispatch personnel in the improper labor dispatch and return mechanism is still prominent and needs to be solved urgently. This paper mainly from the practical point of view, using the method of induction, comparative analysis, combined with the relevant provisions of the Labor contract Law and typical cases, starting from the introduction of the basic situation of labor dispatch in our country, the labor dispatch agencies in our country at present reduce the social security rights and interests of the labor dispatch workers by sending different places to reduce the social security payment rate. The labor dispatch of informal employment organizations causes the dilemma of safeguarding the rights and interests of labor dispatch personnel, and probes into the infringement of the rights and interests of labor dispatch personnel in the return mechanism, puts forward the practical situation and legal problems in the protection of workers' rights and interests, and puts forward some corresponding suggestions for the development and perfection of labor dispatch system and the practical protection of the legitimate rights and interests of labor dispatch personnel, which is of guiding significance for the construction of harmonious labor relations and the maintenance of social stability. Specifically, the structure of this paper is mainly divided into the following four parts: the first part, the basic situation of labor dispatch development in China. This part mainly introduces the definition, characteristics, causes, development process and present situation of labor dispatch in our country, which leads to the problems existing in labor dispatch in our country at present. In the second part, the social security rights and interests of labor dispatch personnel are infringed by different places, combined with typical cases, this paper analyzes the causes of the rise of labor dispatch personnel in different places, and the dilemma of safeguarding the rights of labor dispatch personnel in different places, and puts forward some suggestions. The third part is the infringement of the rights and interests of labor dispatch personnel by informal employment organizations. This part mainly introduces the causes, nature and development status of the organization, analyzes the reasons for the lack of protection of the rights and interests of labor dispatch personnel in the organization, and puts forward how to solve the dilemma. The fourth part, the return mechanism to the labor dispatch personnel rights and interests infringement problem. This part mainly starts with the provisions that labor dispatch personnel can be returned in the Labor contract Law, and analyzes the causes of the return, as well as the dilemma of protecting the rights of the returned workers, and puts forward some suggestions.
