擺正位置——新合同法為推行外貿(mào)代理制提供法律保障

【摘要】：正 我國對外貿(mào)易經(jīng)營體制改革的一項重要內(nèi)容就是“推行外貿(mào)代理制”。然而多年來對這一政策的貫徹落實并不理想。這自然存在認(rèn)識、政策以及貿(mào)易做法等多方面原因,但過去國內(nèi)立法不完善,代理關(guān)系中各方當(dāng)事人得不到公平、合理的保護,是代理制推行不利的一個基本原因�，F(xiàn)在我國新的合同法已經(jīng)頒布,并將于1999年10月1日正式生效,其中對代理問題做出許多新的規(guī)定。
[Abstract]:An important part of the reform of China's foreign trade management system is to carry out the foreign trade agency system. However, the implementation of this policy over the years is not ideal. Naturally, there are many reasons, such as cognition, policy and trade practices, but in the past the domestic legislation was not perfect, and the parties involved in the agency relationship could not get fair and reasonable protection, which was one of the basic reasons for the unfavorable implementation of the agency system. Now the new contract law of our country has been promulgated and will come into effect on October 1, 1999.
