北京市中小企業(yè)勞動(dòng)用工狀況的調(diào)查分析

【摘要】:正《中華人民共和國勞動(dòng)合同法》(以下簡稱《勞動(dòng)合同法》)及其修正案實(shí)施后,為規(guī)范企業(yè)與員工雙方的權(quán)利和義務(wù),保護(hù)勞動(dòng)者的合法權(quán)益提供了法律依據(jù)。然而,在對《勞動(dòng)合同法》帶來影響的眾多研究中,研究者的目光大多集中在它給大型企業(yè)帶來的沖擊和影響,而對中小型企業(yè)適用《勞動(dòng)合同法》的問題關(guān)注甚少。與大企業(yè)相比,中小企業(yè)大多從事勞動(dòng)密集型產(chǎn)業(yè),使用較多的勞動(dòng)力資源,是吸納社會(huì)就業(yè)的主力軍,也是勞動(dòng)關(guān)系領(lǐng)域的重要組成部分。當(dāng)前,中小企業(yè)勞動(dòng)用工的現(xiàn)狀如何?勞動(dòng)用工管理中存在哪些問題?對這些問題的調(diào)查,有助于我們清晰了解中小企業(yè)勞動(dòng)用工的現(xiàn)狀及存在的問題,認(rèn)識(shí)勞動(dòng)合同法及修正案給中小企業(yè)勞動(dòng)用工帶來的影響,以期為制定相關(guān)政策提供參考和依據(jù)。
[Abstract]:After the implementation of the Labor contract Law of the people's Republic of China (hereinafter referred to as Labor contract Law) and its amendment, it provides a legal basis for standardizing the rights and obligations of both enterprises and employees and protecting the legitimate rights and interests of workers. However, in many researches on the impact of the Labor contract Law, the researchers mostly focus on the impact and impact it brings to large enterprises, but little attention is paid to the application of "Labor contract Law" to small and medium-sized enterprises. Compared with large enterprises, small and medium-sized enterprises are mostly engaged in labor-intensive industries and use more labor resources, which is the main force of absorbing social employment and an important part of the field of labor relations. At present, what is the current situation of labor and employment in small and medium-sized enterprises? What are the problems in labor management? The investigation of these problems will help us to understand clearly the present situation and existing problems of labor and employment in small and medium-sized enterprises, and to understand the impact of the labor contract law and its amendments on the employment of small and medium-sized enterprises. In order to provide reference and basis for the formulation of relevant policies.
