無定期勞動合同促進雇傭雙方合作雙贏的思考——對《勞動合同法》的一種人力資本視角分析

【摘要】:本文試從現(xiàn)代人力資本理論的視角對《勞動合同法》中"無固定期限勞動合同"的條款給予新的解析,指出無固定期限勞動合同有利于保證雇傭關(guān)系的穩(wěn)定性,從而為企業(yè)人力資本開發(fā)奠定良好的制度基礎(chǔ)。因此,與學(xué)術(shù)界一些較流行的觀點不同,本文認(rèn)為《勞動合同法》的意義絕不僅僅在于對勞動者利益的保護,它實際上體現(xiàn)了一種從現(xiàn)代成熟的市場經(jīng)濟視角出發(fā),運用法律手段規(guī)范健康有序的勞動關(guān)系,促使勞動者與企業(yè)實現(xiàn)合作雙贏的政府的理性行為。
[Abstract]:From the perspective of modern human capital theory, this paper tries to give a new analysis of the terms of "Labor contract with no fixed term" in the Labor contract Law, and points out that the labor contract with no fixed term is conducive to the stability of the employment relationship. Thus lay a good institutional foundation for the development of human capital. Therefore, different from some popular views in academic circles, this paper holds that the meaning of Labor contract Law is not only to protect the interests of workers, but also to reflect a modern mature market economy perspective. The use of legal means to regulate healthy and orderly labor relations, to promote workers and enterprises to achieve win-win cooperation between the rational behavior of the government.
