【摘要】：針對在鐵路旅客運輸中,因當(dāng)事人對《鐵路旅客運輸規(guī)程》中,關(guān)于學(xué)生票、兒童票、免責(zé)及特定用詞等理解不一引起糾紛的問題。結(jié)合有關(guān)鐵路旅客運輸?shù)姆煞ㄒ?guī),對現(xiàn)行合同條款理解爭議起因與種類進行法律分析,提出了借助《合同法》理解好合同條款、按照公平原則處理好無約定條款來解決好各類合同條款理解爭議的應(yīng)對策略。
[Abstract]:In railway passenger transport, disputes arise because the parties have different understandings of student tickets, children's tickets, exemptions and specific words in Railway passenger Transport regulations. Combined with the laws and regulations concerning railway passenger transport, this paper makes a legal analysis on the understanding of the causes and types of disputes in the current contract terms, and puts forward that the contract terms should be understood well with the aid of the contract Law. According to the principle of fairness, deal with the non-agreement clause to resolve all kinds of contract terms to understand the dispute strategy.
