【摘要】：正當(dāng)前,各地都在進(jìn)行"城中村"改造。筆者在指導(dǎo)一些地方政府進(jìn)行"城中村"改造中探索了協(xié)商搬遷模式,該模式在青島四方區(qū)稱為自主拆遷、成都稱為模擬拆遷,上述模式在法律上都源于附條件合同原理。附條件合同,是指當(dāng)事人在合同中特別規(guī)定一定的條件,以條件是否成就來(lái)決定合同效力的發(fā)生或消滅的合同。《合同法》第45條規(guī)定:"當(dāng)
[Abstract]:At present, everywhere is carrying on the "village in the city" transformation. In guiding some local governments to carry out "village in the city" transformation, the author explores the mode of negotiation relocation, which is called autonomous demolition in Sifang District of Qingdao and simulated demolition in Chengdu. All of the above models are legally derived from the principle of conditional contract. A conditional contract refers to a contract in which the parties specifically stipulate certain conditions to determine the occurrence or extinction of the validity of the contract on the basis of the achievement of the conditions.
