NPL交易的法律問題

【摘要】：雖然NPL在法律上意味著貸款人在貸款合同項下的權(quán)利義務(wù),但其交易則主要采用權(quán)利轉(zhuǎn)讓方式;這種權(quán)利交易在價格確定、交易對象轉(zhuǎn)移時間方面具有自己的特點,這些特點,已經(jīng)映照出主要參考國際貨物買賣公約的我國現(xiàn)行《合同法》的不足;而作為一種權(quán)利買賣,NPL交易的實務(wù)及其總結(jié)抽象將對我國及世界金融衍生產(chǎn)品的交易發(fā)展具有參考價值、示范作用,并能產(chǎn)生互動效果。
[Abstract]:Although NPL legally means the rights and obligations of the lender under the loan contract, its transaction mainly adopts the transfer of rights; this right transaction has its own characteristics in price determination and the time of the object's transfer. The deficiency of China's current contract Law, which mainly refers to the Convention on the International Sale of goods, has been reflected.
