【摘要】：按揭房貸是貸款、抵押和保證的聯(lián)立,其成立并不引起房屋所有權(quán)移轉(zhuǎn)。地震所引起的房屋毀損滅失風(fēng)險應(yīng)依《合同法》和最高人民法院相關(guān)司法解釋解決,房屋在交付使用之前毀損滅失的,風(fēng)險應(yīng)由開發(fā)商承擔(dān),買受人在解除買賣合同之后,無須還貸;房屋在交付使用后毀損滅失的,風(fēng)險應(yīng)由買受人承擔(dān),買受人仍應(yīng)依約還貸。貸款核銷只是商業(yè)銀行內(nèi)部的一種賬務(wù)處理方法,并不能消滅房貸債權(quán)。
[Abstract]:Mortgage is a combination of loan, mortgage and guarantee, and its establishment does not result in the transfer of home ownership. The risk of damage and loss caused by the earthquake shall be resolved in accordance with the contract Law and the relevant judicial interpretations of the Supreme people's Court. If the building is damaged or lost before it is put into use, the risk shall be borne by the developer, and the buyer shall, after the termination of the contract of sale and purchase, There is no need to repay the loan; if the house is damaged or lost after delivery, the risk shall be borne by the buyer, and the buyer shall still pay the loan in accordance with the contract. Loan write-off is only a kind of account handling method inside commercial bank, can not destroy the mortgage creditor's rights.
