【摘要】:高校畢業(yè)生就業(yè)協(xié)議的簽訂是其就業(yè)過(guò)程中的一個(gè)重要環(huán)節(jié),高校畢業(yè)生就業(yè)協(xié)議制度在畢業(yè)生就業(yè)過(guò)程中也發(fā)揮著重要的作用。然而,我國(guó)勞動(dòng)力市場(chǎng)化程度日益提高,高校畢業(yè)生作為勞動(dòng)力市場(chǎng)的重要組成部分,其市場(chǎng)化程度亦同。就業(yè)協(xié)議制度本身存在的問(wèn)題重重,難以滿足現(xiàn)實(shí)市場(chǎng)的需要。該制度也已經(jīng)不能很好地保護(hù)畢業(yè)生的就業(yè)權(quán)益和用人單位的用人權(quán)益,使兩者面臨著極大的法律風(fēng)險(xiǎn)。因此,必須構(gòu)建新的高校畢業(yè)生就業(yè)制度從而有效保障畢業(yè)生和用人單位的權(quán)益。 本文深入分析了就業(yè)協(xié)議制度在理論和實(shí)踐中存在的不足,通過(guò)對(duì)比、分析,認(rèn)為應(yīng)當(dāng)廢除就業(yè)協(xié)議制度而直接適用勞動(dòng)合同制度,在立法層面上提出了具體的修改法律條文的建議。文章共分為四個(gè)部分:第一部分:闡述了高校畢業(yè)生就業(yè)制度的產(chǎn)生背景、發(fā)展歷程、法律性質(zhì)、特征和作用。第二部分:就業(yè)協(xié)議制度在理論和實(shí)踐中存在諸多的問(wèn)題。首先,用人單位和高校畢業(yè)生先簽訂就業(yè)協(xié)議再簽訂勞動(dòng)合同這個(gè)過(guò)程中,存在較長(zhǎng)的時(shí)間間隔,難以保障順利地簽訂勞動(dòng)合同。其次,校方不應(yīng)作為就業(yè)協(xié)議的一方當(dāng)事人。其參與簽訂就業(yè)協(xié)議不具備法理依據(jù),,同時(shí)會(huì)給實(shí)踐操作帶來(lái)諸多問(wèn)題。再次,就業(yè)協(xié)議內(nèi)容簡(jiǎn)單,其沒(méi)有就畢業(yè)生應(yīng)享有的重要權(quán)利作出具體的規(guī)定,給畢業(yè)生就業(yè)權(quán)益的實(shí)現(xiàn)造成諸多阻礙。最后,有關(guān)高校畢業(yè)生就業(yè)協(xié)議制度的立法不系統(tǒng)、層次較低,目前只有部門規(guī)章對(duì)該制度進(jìn)行了相應(yīng)規(guī)定。第三部分:從理論上探討了就業(yè)協(xié)議制度的發(fā)展方向。就業(yè)協(xié)議制度究竟是應(yīng)廢除抑或應(yīng)合并或完善,要進(jìn)行理論和實(shí)踐上的雙重考量。認(rèn)為在我國(guó)當(dāng)前高校畢業(yè)生就業(yè)體制下,合理性的選擇是應(yīng)取消就業(yè)協(xié)議制度,直接適用勞動(dòng)合同制度。第四部分:具體立法條文的修改。建議取消高校畢業(yè)生就業(yè)協(xié)議制度,并廢止《普通高等學(xué)校畢業(yè)生就業(yè)工作暫行規(guī)定》第二十四條,在《勞動(dòng)合同法》中增加有關(guān)明確高校畢業(yè)生是勞動(dòng)合同法適格主體的條款。
[Abstract]:The signing of employment agreement for college graduates is an important link in the process of employment, and the employment agreement system of college graduates also plays an important role in the process of employment of graduates. However, the degree of marketization of labor force in our country is increasing day by day. As an important part of labor market, the degree of marketization of college graduates is the same. The employment agreement system itself has many problems, it is difficult to meet the needs of the real market. The system has not been able to protect the employment rights of graduates and the employment rights of employers, which makes them face great legal risks. Therefore, it is necessary to construct a new employment system for college graduates in order to effectively protect the rights and interests of graduates and employers. This paper deeply analyzes the deficiency of the employment agreement system in theory and practice. Through the comparison and analysis, the author thinks that the employment agreement system should be abolished and the labor contract system should be directly applied. On the legislative level, the author puts forward some suggestions for amending the legal provisions. The article is divided into four parts: the first part: elaborated the university graduate employment system the background, the development course, the legal nature, the characteristic and the function. The second part: there are many problems in the theory and practice of employment agreement system. First of all, in the process of signing employment agreement and labor contract between employer and college graduate, there is a long time interval, so it is difficult to ensure the smooth signing of labor contract. Second, the school should not be a party to the employment agreement. Their participation in the signing of employment agreement does not have legal basis, and will bring many problems to practical operation. Thirdly, the content of employment agreement is simple, and it does not make specific provisions on the important rights that graduates should enjoy, which causes many obstacles to the realization of employment rights and interests of graduates. Finally, the legislation of employment agreement system for college graduates is not systematic, and the level is low. The third part: discusses the development direction of employment agreement system theoretically. Whether the employment agreement system should be abolished or merged or perfected should be considered both theoretically and practically. Under the current employment system of college graduates in China, the reasonable choice is to cancel the employment agreement system and apply the labor contract system directly. The fourth part: the modification of specific legislative provisions. It is suggested that the system of employment agreement for college graduates be abolished and that Article 24 of the interim provisions on Employment of ordinary College graduates be abolished. In the Labor contract Law, a clause is added to make it clear that college graduates are the subject of labor contract law.
