無償搭車人身損害賠償探析

【摘要】:隨著私家車的迅速發(fā)展,有車一族往往會在上下班路上免費順帶同事、鄰居或者在節(jié)假日載上朋友一起出游。然而,一個法律問題卻往往被人們忽視:一旦出了車禍,乘車者受到了人身傷害,損失由誰賠償或補償?司機或車主是否存在減免責任的法定事由,相關(guān)的賠償或補償該按照什么樣的標準?我國對好意同乘侵權(quán)的責任認定在法律上尚屬空白。 本文計劃分三部分,通過對吳鳴訴程振魁、胡愛蓮及西安瀘河管委會人身損害賠償一案的案例分析對好意同乘這一問題進行了論述: 第一章主要對“吳鳴訴程振魁、胡愛蓮及西安瀘河管委會人身損害賠償一案”的案情進行了詳細的介紹,對案件的事實,一、二審的開庭情況及判決結(jié)果進行了整理,并提出本案爭議的焦點問題,力求讓讀者對本案的始末有個清晰的認識,為下面的分析論述做好鋪墊。 第二章對本案具有爭議性的問題進行論述,即本文的研究重點。主要從五方面進行分析: 第一方面,論述好意同乘的概念和特征; 第二方面,無償搭車中搭車人與司機或車主之間是否存在運輸合同關(guān)系,無償搭車人是否有權(quán)依據(jù)《中華人民共和國合同法》第302條的規(guī)定基于客運合同向司機或車主主張人身損害賠償; 第三方面,司機對同乘者是否構(gòu)成侵權(quán); 第四方面,司機或車主對無償搭車人的人身損害承擔責任的歸責原則及承擔責任和免責事由; 第五方面,討論車輛所有人的責任。 第三章對于完善我國的無償搭車人身損害賠償制度的思考。
[Abstract]:With the rapid development of private cars, car owners will often take their colleagues, neighbors or friends on holidays to and from work for free. However, a legal problem is often ignored: in the event of a car accident, the passenger suffered personal injury, who will compensate or compensate for the loss? Does the driver or owner have legal reasons for relief, and what are the criteria for compensation or compensation? The legal confirmation of our country's liability for the infringement of good will is still blank. This paper is divided into three parts, through the case analysis of Wu Ming v. Cheng Zhenkui, Hu Ailian and Xi'an Luhe River Administration Commission, the author discusses the problem of "good intention sharing": the first chapter mainly discusses "Wu Ming v. Cheng Zhenkui," Hu Ailian and the Xi'an Luhe Administrative Commission's personal injury compensation case were introduced in detail, the facts of the case, the first, the court session of the second trial and the result of the judgment were sorted out, and the focus of the dispute was raised. Make every effort to let the reader have a clear understanding of the beginning and end of the case, and pave the way for the following analysis and argumentation. The second chapter discusses the controversial issues in this case, that is, the focus of this paper. It is mainly analyzed from five aspects: first, the concept and characteristics of well-intentioned co-rider; second, whether there is a transportation contract relationship between the rider and the driver or the owner in the free ride. Whether the free rider has the right to claim compensation for personal injury to the driver or the owner on the basis of passenger transport contract in accordance with the provisions of Article 302 of the contract Law of the people's Republic of China; Fourth, the principle of imputation, liability and exemption of the driver or owner for the personal injury of the free rider; fifth, the liability of the owner of the vehicle. The third chapter is about how to perfect the compensation system of free rider personal injury in our country.
