論我國旅客運輸合同的完善

【摘要】:二十世紀九十年代以來,我國客運運輸?shù)幕A設施建設和運行服務質量得到了快速發(fā)展,伴隨著這種飛躍,旅客運輸合同中出現(xiàn)的遲延運輸?shù)瘸羞\人違約行為屢見不鮮,而廣為宣傳的社會主義法治理念進入各家各戶,強化了人們的維權意識,人們對旅客運輸服務質量提出了更高的要求,因此在旅客與承運人之間產(chǎn)生的矛盾有增不減。其中,主要引起糾紛問題就是,旅客運輸合同遲延履行、承運人未履行告知義務、限制退票等,而這些最基本、最常見的旅客運輸合同問題在我國法律法規(guī)中雖有規(guī)定,但現(xiàn)行法律法規(guī)尤其是作為一般法的《合同法》對旅客合法權利的保護仍不周到,無法有效促使承運人充分履行其合同義務,即改進服務質量、提高準點率等,這種現(xiàn)象既不利于在承運人違約時對旅客合法權益的保護,以長遠的眼光來看,其也不利于旅客運輸業(yè)向高效率、高質量方向發(fā)展。本文共分為三章。第一章為“旅客運輸合同基礎理論”,主要闡述了旅客運輸合同的性質在理論上的分歧及其不同立法例比較。其中,旅客運輸合同的性質主要解決當前理論界對于旅客運輸合同屬于服務合同、格式合同和行政合同的爭議;而域外主要國家或地區(qū)旅客運輸合同的立法例主要是與我國比較后,如何借鑒并用于我國旅客運輸合同的完善當中去。第二章為“我國旅客運輸合同的現(xiàn)狀及問題”,通過對“阿卜杜勒·瓦希德訴中國東方航空公司案”和“劉玲訴北京鐵路局案”兩個案例的實證分析,提出在實務中存在承運人違反告知義務、承運人遲延運輸賠償責任和旅客運輸合同解除與變更等問題,現(xiàn)行立法上存在缺陷與不足。第三章為“我國旅客運輸合同具體制度之完善”,針對理論上存在的分歧及實務中表現(xiàn)出來的缺陷,通過考察主要國家和地區(qū)的立法,結合我國實際以及理論研究,相對應的從承運人的告知義務、遲延運輸?shù)馁r償責任與范圍、旅客的合同解除與變更權等方面找出解決路徑,以期完善我國旅客運輸合同。
[Abstract]:Since 1990s, the infrastructure construction and service quality of passenger transport in China have developed rapidly. With this kind of leap, the carrier's breach of contract such as delayed transport in passenger transport contract is common. The concept of socialist rule of law, which has been widely propagated, has strengthened people's awareness of safeguarding their rights and put forward higher demands on the quality of passenger transport services, thus increasing the contradictions between passengers and carriers. Among them, the main disputes are the delay in the performance of the passenger transport contract, the carrier's failure to perform the obligation of notification, the restriction of refund, and so on. These most basic and most common problems of the passenger transport contract are stipulated in the laws and regulations of our country. However, the current laws and regulations, especially the "contract Law" as a general law, are still inadequate to protect the legitimate rights of passengers, and can not effectively urge the carrier to fully fulfill its contractual obligations, that is, to improve the quality of service and increase the punctuality rate, etc. This phenomenon is not conducive to the protection of the legitimate rights and interests of passengers in case of breach of contract by the carrier. In the long run, it is also not conducive to the development of high efficiency and high quality of the passenger transport industry. This paper is divided into three chapters. The first chapter is the basic theory of passenger transport contract, which mainly expounds the theoretical differences of the nature of passenger transport contract and the comparison of different legislative cases. Among them, the nature of passenger transport contract mainly solves the dispute that passenger transport contract belongs to service contract, format contract and administrative contract. The legislative example of passenger transport contract in foreign countries or regions is mainly compared with our country, how to use it for reference and be used in the consummation of passenger transport contract in our country. The second chapter is "the current situation and problems of passenger transport contract in China", through the empirical analysis of two cases: Abdul Wahid v. China Eastern Airlines case and Liu Ling v. Beijing Railway Administration case. It is pointed out that there are some problems in practice, such as the carrier's breach of the obligation of notification, the carrier's liability for delay in carriage and the cancellation and modification of the passenger transport contract, and so on, and there are some defects and deficiencies in the current legislation. The third chapter is "the perfection of the specific system of passenger transport contract in our country", aiming at the differences in theory and the defects in practice, through investigating the legislation of major countries and regions, combining the actual and theoretical research of our country. In order to perfect the passenger transport contract of our country, we should find out the solutions from the carrier's obligation of informing, the liability and scope of delay transportation, the right of cancellation and alteration of passenger's contract and so on.
