【摘要】：施工組織設(shè)計(jì)是建設(shè)工程招投標(biāo)、施工準(zhǔn)備與管理等階段的必備文件。國內(nèi)關(guān)于施工組織設(shè)計(jì)的應(yīng)用研究比較多，但針對(duì)其法律效力的研究比較少且不夠深入。而施工組織設(shè)計(jì)的具體內(nèi)容與項(xiàng)目成本密切相關(guān)，當(dāng)承包方與發(fā)包方遇到法律糾紛時(shí)，施工組織設(shè)計(jì)經(jīng)常被引用而作為證據(jù)。于是，針對(duì)施工組織設(shè)計(jì)的法律效力研究就顯得非常必要。本文是在總結(jié)以往經(jīng)驗(yàn)的基礎(chǔ)上，結(jié)合施工組織設(shè)計(jì)的特殊性和相關(guān)法律、法規(guī)和工程慣例對(duì)其法律效力進(jìn)行研究。 首先，本文介紹了施工組織設(shè)計(jì)的法律效力研究背景、國內(nèi)研究現(xiàn)狀及存在的問題、研究目的、研究意義和研究思路。 其次，闡述了施工組織設(shè)計(jì)、法律效力的理論基礎(chǔ)，指出了科學(xué)立法的原則和法律效力的判斷標(biāo)準(zhǔn)，列出了關(guān)于施工組織設(shè)計(jì)的法律、法規(guī)與規(guī)章條文。然后通過施工組織設(shè)計(jì)在建設(shè)過程中的發(fā)展、內(nèi)容、作用、編制與審批等方面的特殊性研究，結(jié)合法律、法規(guī)條文和工程慣例進(jìn)行分析、推理和論證，，從而得出施工組織設(shè)計(jì)法律效力的結(jié)論。并且從法律的局限、法律的導(dǎo)向性原則、立法與司法的法律淵源等法理學(xué)角度對(duì)前文的分析、推理和論證過程的科學(xué)性和可行性進(jìn)行了證明。 最后，運(yùn)用建筑法、招標(biāo)投標(biāo)法、合同法、工程慣例理論對(duì)幾個(gè)典型案例進(jìn)行分析，從而在實(shí)踐上印證了本文的結(jié)論，理論結(jié)合實(shí)際。 本文的研究旨在為避免關(guān)于施工組織設(shè)計(jì)的法律糾紛或者為快速解決施工組織設(shè)計(jì)的相關(guān)糾紛提供幫助，為建設(shè)工程行業(yè)的有序健康發(fā)展作出貢獻(xiàn)。
[Abstract]:Construction organization design is a necessary document for construction project bidding, construction preparation and management. There are many researches on the application of construction organization design in China, but the research on its legal effect is less and less thorough. The content of the construction organization design is closely related to the project cost. When the contractor and the contracting party encounter a legal dispute, the construction organization design is often cited as evidence. Therefore, it is very necessary to study the legal effect of construction organization design. On the basis of summing up the past experience, this paper studies the legal effect of the construction organization design in combination with the particularity of the construction organization design and the relevant laws, regulations and engineering practices. Firstly, this paper introduces the research background of the legal effect of construction organization design, domestic research status and existing problems, research purposes, research significance and research ideas. Secondly, it expounds the theoretical basis of construction organization design and legal effect, points out the principles of scientific legislation and the judging standard of legal effect, and lists the laws, regulations and regulations of construction organization design. Then through the construction organization design in the construction process development, the content, the function, the establishment and the examination and approval aspect particularity research, unifies the law, the regulation article and the engineering practice carries on the analysis, the reasoning and the demonstration, The conclusion of legal effect of construction organization design is obtained. And from the point of view of the limitation of law, the guiding principle of law, the legal origin of legislation and judicature, the author proves the scientific nature and feasibility of the process of analysis, reasoning and argumentation. Finally, this paper analyzes several typical cases by using the construction law, bidding law, contract law and engineering convention theory, which proves the conclusion of this paper in practice and combines theory with practice. The purpose of this paper is to help avoid the legal disputes about the construction organization design or to solve the related disputes of the construction organization design quickly, and to contribute to the orderly and healthy development of the construction engineering industry.
