我國(guó)勞務(wù)派遣法律制度完善研究

【摘要】:勞務(wù)派遣是一種非典型的用工形式,其產(chǎn)生的背景是傳統(tǒng)用工形式滿足不了機(jī)器化大生產(chǎn)的需要。它的出現(xiàn)是歷史的必然,也代表著勞動(dòng)力市場(chǎng)的進(jìn)一步成熟。與域外各國(guó)相比較,我國(guó)的勞務(wù)派遣發(fā)展時(shí)間短,發(fā)展態(tài)勢(shì)迅猛,既取得了很大的成就,同時(shí)也暴露出許多問(wèn)題。存在市場(chǎng)準(zhǔn)入標(biāo)準(zhǔn)低、未做出具體的分類、責(zé)任承擔(dān)不明晰、同工同酬原則難以落實(shí)等問(wèn)題。2008年實(shí)施的《勞動(dòng)合同法》對(duì)勞務(wù)派遣這一用工形式專門劃分出一節(jié)來(lái)進(jìn)行詳細(xì)的規(guī)定。2012年全國(guó)人大常委會(huì)通過(guò)了《勞動(dòng)合同法》修正案,對(duì)勞務(wù)派遣制度進(jìn)行了一系列修改。之后,國(guó)家又相繼出臺(tái)了《勞務(wù)派遣行政許可實(shí)施辦法》、《勞務(wù)派遣暫行規(guī)定》。從中我們可以看出,雖然經(jīng)歷了一系列的改革和調(diào)整,但在規(guī)范上、理論基礎(chǔ)上,勞務(wù)派遣法律制度實(shí)際上仍然存在著許多未解的難題,所以立法者才會(huì)對(duì)勞務(wù)派遣領(lǐng)域給予持續(xù)的關(guān)注。之所以會(huì)出現(xiàn)上述問(wèn)題,原因并不單一。但從本質(zhì)上來(lái)說(shuō),還是因?yàn)椴⑽葱纬赏陚涞膭趧?wù)派遣法律制度。與成熟的市場(chǎng)經(jīng)濟(jì)國(guó)家相比,我國(guó)勞務(wù)派遣制度以及勞務(wù)派遣法律制度相對(duì)而言不太成熟。有鑒于此,要想促進(jìn)勞務(wù)派遣行業(yè)健康發(fā)展,需要吸取成熟勞務(wù)派遣國(guó)家的經(jīng)驗(yàn)教訓(xùn),加強(qiáng)對(duì)勞務(wù)派遣法律制度的完善。本文對(duì)勞務(wù)派遣的論述主要有以下幾個(gè)部分:第一部分對(duì)勞務(wù)派遣的基礎(chǔ)性問(wèn)題進(jìn)行了分析,包括勞務(wù)派遣的概念與特征、起源與歷史發(fā)展、分類。第二部分為我國(guó)勞務(wù)派遣法律制度的現(xiàn)狀與存在的不足,在分析了現(xiàn)行的勞務(wù)派遣法律制度后指出了其不足之處。第三部分,則是介紹域外立法經(jīng)驗(yàn)及對(duì)我國(guó)的啟示。在著重闡述美國(guó)、日本等國(guó)對(duì)于勞務(wù)派遣的法律制度以后,從中提取共性,從而得到可以吸取的經(jīng)驗(yàn)。第四部分,提出完善我國(guó)勞務(wù)派遣的立法建議。勞務(wù)派遣雖然是一種補(bǔ)充用工形式,但其有著一系列優(yōu)點(diǎn),諸如有利于簡(jiǎn)化管理程序,減少勞動(dòng)爭(zhēng)議,分擔(dān)風(fēng)險(xiǎn)和責(zé)任,降低成本費(fèi)用,自主靈活用工,規(guī)范用工行為等,從而能夠推動(dòng)勞動(dòng)力市場(chǎng)的進(jìn)一步成熟。所以,完善我國(guó)勞務(wù)派遣法律制度,從法律層面加以規(guī)范,勢(shì)在必行。
[Abstract]:Labor dispatch is an atypical form of employment, whose background is that the traditional form of employment can not meet the needs of large-scale production. Its emergence is a historical necessity, but also represents the further maturity of the labor market. Compared with overseas countries, China's labor dispatch has a short development time and a rapid development situation, which has made great achievements, but also exposed many problems. There are low market access standards, no specific classifications, unclear responsibilities, It is difficult to implement the principle of equal pay for work of equal value. The Labor contract Law, which was implemented in 2008, specifically divides the labor dispatch form into a section to carry out detailed provisions. In 2012, the standing Committee of the National people's Congress adopted an amendment to the Labor contract Law. A series of changes have been made to the labor dispatch system. After that, the state has issued the Administrative Licensing measures for Labor dispatching and the interim regulations on Labor dispatching. We can see that although we have experienced a series of reforms and adjustments, there are still many unsolved problems in the legal system of labor dispatch on the basis of norms and theories. So legislators will continue to pay attention to the field of labor dispatch. The reasons for these problems are not single. But in essence, it is because it has not formed a complete legal system of labor dispatch. Compared with mature market economy countries, China's labor dispatch system and labor dispatch legal system are relatively immature. In view of this, in order to promote the healthy development of labor dispatch industry, it is necessary to absorb the experience and lessons of mature labor dispatch countries and strengthen the perfection of the legal system of labor dispatch. This article mainly has the following several parts to the labor dispatch discussion: the first part has carried on the analysis to the labor service dispatch basic question, including the service dispatch concept and the characteristic, the origin and the historical development, the classification. The second part is the current situation and shortcomings of the legal system of labor dispatch in China, and points out its shortcomings after analyzing the current legal system of labor dispatch. The third part introduces the experience of foreign legislation and its enlightenment to our country. After expounding the legal system of labor dispatch in America, Japan and other countries, we can draw some common points from it. The fourth part, put forward the legislation suggestion of perfecting our country labor dispatch. Although labor dispatch is a supplementary form of employment, it has a series of advantages, such as to simplify management procedures, reduce labor disputes, share risks and responsibilities, reduce costs, work independently and flexibly, standardize employment behavior, and so on. This will enable the further maturity of the labour market. Therefore, it is imperative to perfect the legal system of labor dispatch and standardize it from the legal level.
