【摘要】：正關于錄用通知書的性質(zhì)與法律效力問題,在我國勞動法律中并無相關規(guī)定,實踐中往往要結(jié)合《合同法》的規(guī)定來考慮和判斷。從勞動合同締結(jié)程序來看,員工的錄用過程完全符合《合同法》中關于合同締結(jié)過程中關于要約與承諾的規(guī)定。因此錄用通知書從法律性質(zhì)上講是一種要約。錄用通知書對于用人單位來說一經(jīng)發(fā)出到達勞動者后即生效,用人單位不得撤銷,而對于勞動者來說,其收到錄用通知書,既可以選擇承諾,也可以選擇放棄,如果選
[Abstract]:There are no relevant provisions in China's labor law about the nature and legal effect of the employment notice. In practice, it is often considered and judged in conjunction with the provisions of contract Law.From the point of view of labor contract conclusion procedure, the employment process of employees fully accords with the stipulations of contract law on offer and acceptance in the process of contract conclusion.So a notice of employment is an offer by its legal nature.The employment notice is effective once the employer has reached the laborer, and the employer may not cancel it.
