【摘要】:在當(dāng)前消費(fèi)者維權(quán)的過(guò)程中,廠商合法利益被侵害而又無(wú)力維權(quán)的情況比比皆是。同時(shí),經(jīng)營(yíng)者的利益讓步并未緩解消費(fèi)者和經(jīng)營(yíng)者之間的矛盾,現(xiàn)今中國(guó)消費(fèi)者和經(jīng)營(yíng)者之間的利益沖突日益激烈,彼此安全感低下。在這樣的環(huán)境中,社會(huì)資源被大量消耗,交易關(guān)系不平等現(xiàn)象兩極化,善良誠(chéng)信風(fēng)俗被惡化,不利于經(jīng)濟(jì)的可持續(xù)性和健康發(fā)展。 對(duì)于消費(fèi)者維權(quán)過(guò)度、甚或敲詐,廠商往往會(huì)投入巨大的財(cái)力、人力去平息爭(zhēng)議。原因既有主觀、亦有客觀的。主觀原因常常體現(xiàn)為廠商希望和氣生財(cái),花錢消災(zāi),只要損失還在可承受范圍之內(nèi),就不去維護(hù)自己的合法權(quán)益。客觀原因方面,有很多,例如,當(dāng)前社會(huì)反向不均衡的法律現(xiàn)狀,社會(huì)上不健康的輿論導(dǎo)向壓力等,都令廠商對(duì)于合理維權(quán)望而卻步。基于這樣的背景,本文探討的是消費(fèi)者權(quán)益保護(hù)法下廠商合法權(quán)益的維護(hù)問(wèn)題。 本文的基本框架,除引言和結(jié)尾外,共分為四大部分: 第一章為廠商合法利益被侵害的問(wèn)題分析。主要闡述、分析、總結(jié)了廠商合法利益被侵害的現(xiàn)狀、影響及根源。 第二章為我國(guó)大陸地區(qū)調(diào)解消費(fèi)者與經(jīng)營(yíng)者利益的法律制度現(xiàn)狀。分別探討了消費(fèi)者權(quán)益保護(hù)的法律現(xiàn)狀和經(jīng)營(yíng)者權(quán)益保護(hù)的法律現(xiàn)狀。 第三章著重陳述并研討其它國(guó)家和地區(qū)在廠商合法利益保護(hù)方面,有哪些立法經(jīng)驗(yàn)。其中分別從如下幾個(gè)方面作了比對(duì)說(shuō)明和優(yōu)缺點(diǎn)闡述:消保法的基本目標(biāo)、原則;維權(quán)過(guò)度和敲詐勒索的界限;消費(fèi)者資訊及教育;刑事處罰手段;消費(fèi)者合同法;迅速、廉價(jià)、便捷的糾紛解決程序性規(guī)則;中立公正的糾紛調(diào)解機(jī)構(gòu);經(jīng)營(yíng)者救濟(jì)手段。 第四章筆者闡述了在消費(fèi)者保護(hù)法下經(jīng)營(yíng)者合法權(quán)益保護(hù)方面的立法建議。
[Abstract]:In the current process of protecting the rights of consumers, manufacturers meet the eye everywhere legitimate interests have been infringed and unable to rights. At the same time, in the interests of the operators did not alleviate the contradiction between consumers and operators, the conflict of interests between consumers and operators Chinese nowadays increasingly fierce, each other a sense of security is low. In this environment, the society consume a lot of resources the relationship between trade, inequality polarization, good integrity of Customs was worse, not conducive to the sustainable and healthy development of economy.
For consumer rights over, or even extortion, manufacturers tend to invest huge amounts of money and manpower to quell the controversy. Both subjective reasons, there are objective and subjective reasons. Often reflects manufacturers hope huaqianxiaozai, as long as the loss of Friendliness is conducive to business success., still affordable range, not to safeguard their legitimate rights and interests. The objective reasons. There are a lot of, for example, the legal status of the current social reverse unbalanced society, not the health of public opinion pressure, make reasonable rights for manufacturers prohibitive. Based on this background, this paper discusses the maintenance of the legitimate rights and interests of manufacturers in the consumer protection act.
In addition to the introduction and the end, the basic framework of this paper is divided into four parts.
The first chapter is the analysis of the problems that the firm's legal interests have been infringed on. It mainly expounds, analyzes and summarizes the status, influence and root of the infringed interests of the manufacturers.
The second chapter is the current situation of the legal system to mediate the interests of consumers and operators in mainland China. It discusses the legal status of consumer rights protection and the legal status of the protection of the rights and interests of operators.
The third chapter focuses on the presentation and discussion of other countries and regions in the legal protection of the interests of manufacturers, which has been compared. The legislative experience shows respectively from the following aspects: the advantages and disadvantages of the basic goal of consumer protection law; excessive rights and limits of blackmail and impose exactions on information and education; consumers; consumer contract means of criminal punishment; method; fast, cheap, and convenient procedure rules to solve the disputes; neutral and impartial dispute mediation mechanism; executive relief means.
In the fourth chapter, the author expounds the legislative proposals on the protection of the legitimate rights and interests of the operators under the consumer protection law.
