【摘要】：正主持人:勞動者以用人單位未足額繳納社會保險費(fèi)、違背《勞動合同法》第三十八條規(guī)定為由,向用人單位遞交書面辭職報(bào)告,并給用人單位人事主管打電話說明這一事實(shí),要求用人單位支付解除勞動合同的經(jīng)濟(jì)補(bǔ)償金。在之后發(fā)生的勞動仲裁中,勞動者提交了有公司門衛(wèi)簽收的書面辭職報(bào)告、電話錄音。但用人單位主張?jiān)摵炞趾弯浺艟徽鎸?shí)(此時門衛(wèi)和錄音中人事主管均已從公司離職)。請問,這兩份證據(jù)能否采信?如果不能采信,勞動者的訴求能否成立?
[Abstract]:The direct host: the laborer, on the grounds that the employer has not paid the social insurance premium in full and violates the provisions of Article 38 of the Labor contract Law, submits a written resignation report to the employing unit, and calls the head of personnel of the unit to explain this fact.Ask unit of choose and employ persons to pay the economic compensation that terminates labor contract.In the subsequent labor arbitration, the laborer submitted a written resignation report signed by the company doorman and recorded the phone.But the employer argued that the signature and recording were not true (both the doorman and the recording officer had left the company.May I ask whether these two pieces of evidence are admissible?If not, can the demands of workers be established?
