【摘要】：在違約損害賠償制度中有一個重要的組成部分——可得利益損失賠償，關(guān)于可得利益損失賠償各國都進行了大量的研究，并在立法中進行了規(guī)定。我國雖然在《合同法》第113條中對其做出了規(guī)定，但由于規(guī)定過于原則化，在實踐中難于操作，因此并不能很好的保護守約方的實際利益。本文針對這一問題，從不同的角度對違約可得利益損失進行闡述，，希望能夠理清相關(guān)的問題。本文主要分為三個部分，第一部分首先闡述可得利益損失的概念和特點，進而分析對可得利益損失進行賠償?shù)谋匾裕⒃诹私饪傻美鎿p失概念和特點的基礎(chǔ)上，分析闡述可得利益與外國相關(guān)利益之間的關(guān)系，主要是可得利益與期待利益和履行利益之間的關(guān)系，可得利益損失與信賴利益損失之間的關(guān)系，可得利益損失與直接損失、間接損失之間的關(guān)系，可得利益損失與機會喪失之間的關(guān)系，以及可得利益損失與“結(jié)果性”損害之間的關(guān)系。通過對幾大利益之間的比較，更好的了解了可得利益損失與相關(guān)概念之間的區(qū)別和聯(lián)系，特別是對于“結(jié)果性”損害和機會損失的概念比較，可以使我們更好的理解和借鑒國外的相關(guān)規(guī)定。第二部分主要介紹外國相關(guān)的立法例和我國對于可得利益損失的立法，并對我國《合同法》相關(guān)法條進行了評析。第三部分首先闡述了可得利益損失賠償?shù)臉?gòu)成要件，然后闡述了可得利益損失的舉證責任及證明標準接著筆者對于可得利益損失的賠償規(guī)則進行了分析，并分析了可得利益損失的具體計算方法。最后，筆者分析對可得利益損失進行賠償?shù)南拗圃瓌t，并就其中的可預見性原則進行了具體的闡述。
[Abstract]:There is an important component in the system of compensation for damages for breach of contract-compensation for the loss of available interests. Many countries have carried out a great deal of research on compensation for loss of available interests, which has been stipulated in the legislation.Although our country has stipulated it in Article 113 of contract Law, because the stipulation is too principled, it is difficult to operate in practice, so it can not protect the actual interests of the compliance party.Aiming at this problem, this paper expounds the loss of interest from different angles and hopes to clear up the related problems.This paper is mainly divided into three parts. The first part describes the concept and characteristics of the loss of available interests, and then analyzes the necessity of compensation for the loss of available interests, and on the basis of understanding the concept and characteristics of the loss of available interests,This paper analyzes the relationship between the available interest and the foreign related interest, mainly the relationship between the obtainable interest, the expected interest and the performing interest, the relationship between the loss of the obtainable interest and the loss of the trust interest, the loss of the obtainable interest and the direct loss.The relationship between the indirect loss, the loss of available benefits and the loss of opportunity, and the relationship between the loss of available benefits and the damage of "resultant".A better understanding of the differences and linkages between the loss of available benefits and related concepts, especially with regard to "consequential" harm and loss of opportunity, has been achieved by comparing several major interests,Can make us better understand and learn from the relevant foreign regulations.The second part mainly introduces the relevant legislation of foreign countries and the legislation of the loss of interest in our country, and analyzes the relevant articles of the contract Law of our country.The third part expounds the constitutive elements of the compensation for the loss of available interests, and then expounds the burden of proof and the standard of proof of the loss of the available interests. Then the author analyzes the rules of compensation for the losses of the available interests.The concrete calculation method of the loss of available benefits is also analyzed.Finally, the author analyzes the limitation principle of compensation for the loss of available interests, and expounds the principle of predictability.
