【摘要】：跨境電子商務是電子商務發(fā)展到一定階段的產(chǎn)物,其主要有B2B、B2C、C2C三種模式。近年來,隨著社交網(wǎng)絡的快速發(fā)展和普及,一種依托于社交網(wǎng)絡的新型跨境代購模式,即社交型C2C跨境代購模式應運而生。這種新型代購模式具有高度信任性、小眾化、針對性強等特點,深受消費者特別是中上層消費者的喜愛。但是,社交型C2C跨境代購行為目前處于《海關法》《消費者權益保護法》等相關法律法規(guī)沒有相關規(guī)定,無法有效調整的狀態(tài)。為了保護買賣雙方特別是買方的合法權益,提出了針對海關法和消費者權益保護法的立法建議和制度構建。并且指出,在沒有出臺相應法律法規(guī)之前,應當依照《合同法》的相關規(guī)定對此種行為進行調整,并對代購行為中出現(xiàn)的具體問題進行合同法分析。
[Abstract]:Cross-border electronic commerce is the product of the development of electronic commerce to a certain stage. There are mainly three modes of B2BX B2C2C2C. In recent years, with the rapid development and popularization of social networks, a new type of cross-border purchasing model based on social networks has been developed. That is, the social C2C cross-border purchase model emerged as the times require. This new mode has the characteristics of high trust, small crowd, strong pertinence and so on, and is loved by consumers, especially middle and upper class consumers. However, The social C2C cross-border purchasing behavior is currently in a state where relevant laws and regulations, such as the Customs Law and the Consumer Rights and interests Protection Law, do not have relevant provisions and cannot be effectively adjusted. In order to protect the legitimate rights and interests of buyers and sellers, especially buyers, This paper puts forward legislative suggestions and system construction for customs law and consumer rights and interests protection law, and points out that such behavior should be adjusted in accordance with the relevant provisions of the contract Law before relevant laws and regulations are issued. And the specific problems in the act of purchasing on behalf of the analysis of contract law.
