【摘要】：專有出版權是出版社在激烈市場競爭中的"命門"和"利器"。本文從《出版管理條例》和《著作權法》的角度分析了自然人享有專有出版權的原因,從《合同法》的角度分析了解除出版合同的實質(zhì)和程序要求,并提醒出版社在與書商合作時應當注意的專有出版權問題。
[Abstract]:The exclusive publishing right is the "lifeline" and "sharp weapon" of the publishing house in the fierce market competition. This paper analyzes the reasons why the natural person enjoys the exclusive publishing right from the angle of the publication Administration regulations and the copyright Law. From the angle of contract Law, this paper analyzes the essential and procedural requirements of the dissolution of the publishing contract, and reminds the publishing house to pay attention to the exclusive publishing right when cooperating with the bookseller.
