【摘要】：虛擬財(cái)產(chǎn)是指具有財(cái)產(chǎn)性的數(shù)字記錄,且不以網(wǎng)絡(luò)虛擬財(cái)產(chǎn)為限。按照《物權(quán)法》的規(guī)定,部分虛擬財(cái)產(chǎn)可以被認(rèn)為是物,適用《物權(quán)法》規(guī)則,這些虛擬財(cái)產(chǎn)應(yīng)被稱為虛擬物。其他虛擬財(cái)產(chǎn)則應(yīng)認(rèn)定為合同債權(quán)性質(zhì)的服務(wù),適用《合同法》規(guī)則,侵害債權(quán)性虛擬財(cái)產(chǎn)適用侵害債權(quán)法律制度。
[Abstract]:Virtual property refers to the digital record of property, which is not limited to network virtual property. According to the provisions of the property Law, part of the virtual property can be regarded as an object, and the rules of the property Law are applicable. These virtual property should be called virtual property, other virtual property should be regarded as the service of contract creditor's rights, the rules of contract law should be applied, and the legal system of infringing creditor's rights should be applied to the infringement of fictitious property.
