【摘要】：我國(guó)《合同法》規(guī)定了締約過(guò)失責(zé)任,但是對(duì)其損失的賠償范圍,包括如何確定機(jī)會(huì)損失等問(wèn)題,并沒(méi)有規(guī)定。為了更明確地界定締約過(guò)失損失的范圍,對(duì)締約過(guò)失責(zé)任的定義、性質(zhì)以及確定損失范圍的原則等問(wèn)題進(jìn)行了探討,并且通過(guò)一個(gè)典型的例子具體分析了機(jī)會(huì)損失如何計(jì)算較為合理。
[Abstract]:The contract Law of our country stipulates the liability for fault in contracting, but the scope of compensation for its loss, including how to determine the loss of opportunity, is not stipulated. In this paper, the definition, nature and principle of determining the scope of loss are discussed, and how to calculate opportunity loss is analyzed through a typical example.
