地方工會(huì)主導(dǎo)下的勞動(dòng)爭(zhēng)議調(diào)解機(jī)制探析

【摘要】:自《勞動(dòng)合同法》出臺(tái)以來(lái),廣大勞動(dòng)者的維權(quán)意識(shí)終被喚醒。在此背景下,勞動(dòng)爭(zhēng)議案件數(shù)量以2008年為分界點(diǎn)經(jīng)歷了急劇增長(zhǎng),全國(guó)多個(gè)法院成立了專門的勞動(dòng)爭(zhēng)議審判庭,但目前的司法解決機(jī)制仍無(wú)法從容應(yīng)對(duì)如此數(shù)量的案件。社會(huì)各方均在考慮、探索如何破解這一難題。本文著眼于進(jìn)入勞動(dòng)仲裁之前的調(diào)解階段,通過(guò)完善該階段的機(jī)制,尤其是明確該階段牽頭方,使我國(guó)的勞動(dòng)爭(zhēng)議調(diào)解機(jī)制能夠形成切實(shí)高效的模式,維護(hù)勞動(dòng)者權(quán)益,平衡勞動(dòng)力市場(chǎng),為緩解勞動(dòng)爭(zhēng)議案件的訴訟激增做出一定的貢獻(xiàn)。本文第一章歸納了我國(guó)勞動(dòng)爭(zhēng)議解決機(jī)制和調(diào)解機(jī)制的歷史變遷及目前的主要做法,通過(guò)對(duì)S市X區(qū)的實(shí)踐分析了目前勞動(dòng)爭(zhēng)議調(diào)解機(jī)制中主導(dǎo)方所面臨的困境,阻礙著調(diào)解機(jī)制的有效發(fā)揮作用。第二章對(duì)勞動(dòng)爭(zhēng)議的特點(diǎn)及產(chǎn)生原因進(jìn)行分析,揭示出在這過(guò)程中正是由于工會(huì)的缺失才引發(fā)后續(xù)的爭(zhēng)議,并對(duì)我國(guó)工會(huì)的屬性進(jìn)行了分析,提出在勞動(dòng)爭(zhēng)議萌芽期間工會(huì)是最適格的調(diào)解主體,指出地方工會(huì)從性質(zhì)上、職能上以及使命上均能夠擔(dān)負(fù)起勞動(dòng)爭(zhēng)議調(diào)解階段的主導(dǎo)角色。第三章基于地方工會(huì)為主導(dǎo)的模式下,提出對(duì)于勞動(dòng)爭(zhēng)議調(diào)解機(jī)制的有效建議。
[Abstract]:Since the introduction of the Labor contract Law, the awareness of protecting the rights of the broad masses of workers has been awakened. Under this background, the number of labor dispute cases has experienced a rapid growth with 2008 as the dividing point, and many courts throughout the country have set up specialized labor dispute courts. However, the current judicial settlement mechanism is still unable to deal with such a large number of cases. All parties in the society are considering how to solve this problem. This paper focuses on the mediation stage before entering labor arbitration, through perfecting the mechanism of this stage. In particular, to clarify the lead party in this stage, so that the labor dispute mediation mechanism of our country can form a practical and efficient model, safeguard the rights and interests of workers, and balance the labor market, In order to alleviate the proliferation of labor dispute cases, the first chapter summarizes the historical changes of labor dispute settlement mechanism and mediation mechanism in China and the current main methods. Based on the practice of X District of S City, this paper analyzes the difficulties faced by the leading parties in the present labor dispute mediation mechanism, which hinders the effective use of the mediation mechanism. The second chapter analyzes the characteristics and causes of labor dispute. This paper reveals that it is the lack of trade unions in this process that leads to subsequent disputes, and analyzes the attributes of trade unions in our country, and points out that trade unions are the most suitable subject of mediation during the embryonic period of labor disputes, and points out that local trade unions are of the nature. In the third chapter, based on the model of local trade union, the author puts forward some effective suggestions for the mediation mechanism of labor dispute.
