勞務(wù)派遣用工中的政府規(guī)制研究

【摘要】:勞務(wù)派遣作為一種新用工方式,在我國(guó)實(shí)行改革開(kāi)放、建立社會(huì)市場(chǎng)經(jīng)濟(jì)后開(kāi)始萌芽。由于勞動(dòng)力市場(chǎng)機(jī)制調(diào)節(jié)的需求,勞務(wù)派遣用工在我國(guó)的發(fā)展速度非常快,2008年我國(guó)首次在《中華人民共和國(guó)勞動(dòng)合同法》中對(duì)勞務(wù)派遣用工進(jìn)行規(guī)制,但是實(shí)際的規(guī)范效果并不明顯,勞務(wù)派遣用工暴露的問(wèn)題也逐年增多,于是2013年我國(guó)政府對(duì)《中華人民共和國(guó)勞動(dòng)合同法》中關(guān)于勞務(wù)派遣的規(guī)定進(jìn)行了修訂,國(guó)家人力資源和社會(huì)保障部也在2014年3月公布了《勞務(wù)派遣暫行規(guī)定》,以期進(jìn)一步規(guī)范勞務(wù)派遣用工管理,促進(jìn)勞務(wù)派遣行業(yè)的健康發(fā)展。本文首先從我國(guó)勞務(wù)派遣用工現(xiàn)狀出發(fā),對(duì)勞務(wù)派遣用工的數(shù)量、地區(qū)分布情況、行業(yè)分布情況和從業(yè)人員構(gòu)成情況進(jìn)行了總結(jié),并對(duì)勞務(wù)派遣在我國(guó)產(chǎn)生和發(fā)展的背景、發(fā)展過(guò)程和發(fā)展特征進(jìn)行了分析,同時(shí)選擇了內(nèi)蒙古自治區(qū)某大型國(guó)有企業(yè)為案例,闡述了企業(yè)勞務(wù)派遣用工情況和規(guī)范勞務(wù)派遣的難點(diǎn)。通過(guò)對(duì)勞務(wù)派遣用工現(xiàn)狀的分析,總結(jié)出我國(guó)勞務(wù)派遣用工中暴露出的政府的問(wèn)題,并歸納為法律法規(guī)體系建設(shè)滯后、行政許可和行業(yè)準(zhǔn)入的弱約束、監(jiān)督管理不到位、社會(huì)保障體系不健全等四個(gè)方面,認(rèn)為勞務(wù)派遣在我國(guó)仍有廣泛的發(fā)展空間,而勞務(wù)派遣的健康持續(xù)發(fā)展,需要政府的進(jìn)一步規(guī)制。通過(guò)總結(jié)分析我國(guó)勞務(wù)派遣用工中暴露的問(wèn)題,同時(shí)借鑒國(guó)外政府相對(duì)成熟的規(guī)制經(jīng)驗(yàn)和做法,論文的最后部分對(duì)政府在規(guī)制勞務(wù)派遣中的職責(zé)和政府規(guī)制勞務(wù)派遣的思路進(jìn)行了論述,并提出了完善法律法規(guī)體系、規(guī)范勞務(wù)派遣適用范圍、加強(qiáng)監(jiān)管和監(jiān)督力度、加快社會(huì)保障體系的建立、充分發(fā)揮政府協(xié)調(diào)作用、鼓勵(lì)發(fā)展行業(yè)協(xié)會(huì)和研究建立勞務(wù)派遣員工的"轉(zhuǎn)正"機(jī)制等七個(gè)政府規(guī)制勞務(wù)派遣可采取的具體方法。
[Abstract]:Labor dispatch, as a new way of employment, began to sprout after the implementation of reform and opening up and the establishment of a social market economy in China. In 2008, labor dispatch was regulated in the Labor contract Law of the people's Republic of China for the first time, but the actual standard effect was not obvious. The problems of labor dispatch are increasing year by year, so in 2013, our government revised the regulation of labor dispatch in the Labor contract Law of the people's Republic of China. On March 2014, the Ministry of Human Resources and Social Security of the State also promulgated the interim provisions on Labor dispatching, with a view to further standardizing the management of labor dispatch. Firstly, from the point of view of the present situation of labor dispatch in our country, this paper summarizes the quantity, regional distribution, industry distribution and employee composition of labor dispatch. The background, development process and characteristics of labor dispatch in China are analyzed, and a large state-owned enterprise in Inner Mongolia Autonomous region is selected as a case. This paper expounds the employment situation of labor dispatch in enterprises and the difficulties in standardizing it. Through the analysis of the present situation of labor dispatch in China, the problems of government exposed in the employment of labor dispatch in China are summarized, and the construction of laws and regulations system is lagged behind. From the four aspects of weak restriction of administrative license and industry access, inadequate supervision and management, and imperfect social security system, it is considered that labor dispatch still has extensive development space in our country, and the healthy and sustainable development of labor dispatch. Through summing up and analyzing the problems exposed in the labor dispatch of our country, at the same time drawing lessons from the relatively mature regulatory experience and practices of foreign governments, In the last part of the paper, the author discusses the responsibility of the government in regulating labor dispatch and the idea of government regulating labor dispatch, and puts forward to perfect the system of laws and regulations, standardize the applicable scope of labor dispatch, strengthen the supervision and supervision. To accelerate the establishment of social security system, to give full play to the role of government coordination, to encourage the development of trade associations and to study the establishment of labor dispatch staff "transformation" mechanism, seven government regulations can be adopted to regulate the specific methods of labor dispatch.
