【摘要】：當(dāng)今，老齡化已經(jīng)成為世界性課題。隨著老齡人口的不斷增長(zhǎng)，各國(guó)相繼完善法律，試圖對(duì)老年人群的權(quán)益做更好的保護(hù)，老年人的監(jiān)護(hù)因此成為一個(gè)重要議題。為了更好地對(duì)老年人進(jìn)行保護(hù)，，我國(guó)于2012年修改了《老年人權(quán)益保障法》，并提出了意定監(jiān)護(hù)的養(yǎng)老方式。這使得老年人可以按自己的意思安排將來(lái)的生活，充分尊重了老年人的自我決定權(quán)，同時(shí)也體現(xiàn)了意定監(jiān)護(hù)制度的靈活性和自治性。然而，我國(guó)民法對(duì)監(jiān)護(hù)制度的規(guī)定并不完備，本文將意定監(jiān)護(hù)合同作為討論的重點(diǎn)，希望對(duì)民法典中的老年監(jiān)護(hù)制度完善有所裨益。 本文從老年監(jiān)護(hù)制度談起，對(duì)該制度的發(fā)展和原則進(jìn)行了梳理，試圖對(duì)老年意定監(jiān)護(hù)制度合同進(jìn)行簡(jiǎn)要的概述。意定監(jiān)護(hù)合同作為一項(xiàng)特殊的合同符合合同的基本規(guī)范，訂立協(xié)議的雙方當(dāng)事人本著意思自治的原則協(xié)商權(quán)利義務(wù)，對(duì)將來(lái)的監(jiān)護(hù)事務(wù)進(jìn)行約定。因?yàn)楸O(jiān)護(hù)的特殊性所以需要對(duì)實(shí)施監(jiān)護(hù)一方的資格做出一定的限制。對(duì)于合同效力的討論，筆者認(rèn)為不應(yīng)當(dāng)突破合同的基本原則，意定監(jiān)護(hù)合同也應(yīng)該在意思表達(dá)一致時(shí)成立、法律做出評(píng)價(jià)時(shí)生效。關(guān)于老年監(jiān)護(hù)合同可能出現(xiàn)的無(wú)效或可撤銷情形，雖然有著特殊之處但仍與一般的合同差別不大。考慮到公權(quán)力對(duì)意定監(jiān)護(hù)合同的保障，文章最后從意定監(jiān)護(hù)合同的程序監(jiān)督入手，討論如何保障合同的履行、如何更好地保障被監(jiān)護(hù)人的利益。 總體而言，意定監(jiān)護(hù)合同不僅要遵循民法和合同法的部分原則，也應(yīng)體現(xiàn)老年監(jiān)護(hù)的特殊性。公權(quán)力機(jī)關(guān)在合同的簽訂、履行中也發(fā)揮著重要作用。從合同生效時(shí)的審查，到履行時(shí)的監(jiān)督，都離不開(kāi)權(quán)力機(jī)關(guān)，這也是意定監(jiān)護(hù)合同具有的倫理親情和社會(huì)保障的特點(diǎn)使然，只有當(dāng)事人的自由意思與國(guó)家干預(yù)、監(jiān)督、保障相結(jié)合，意定監(jiān)護(hù)合同才能更好地發(fā)揮它的積極作用。
[Abstract]:Today , aging has become a worldwide topic . With the increasing of the aged population , all countries have improved their laws and tried to better protect the rights and interests of the elderly . In order to better protect the old people , the old people ' s guardianship has become an important topic . In order to better protect the old people , the old people can arrange the future life according to their own meaning , and also embody the flexibility and autonomy of the intended monitoring system . However , the provisions of the guardianship system are not complete in our country . However , the article puts forward the supervision contract as the focus of the discussion , and hopes to help the old age monitoring system in the civil code . This article reviews the development and principles of the system from the old age monitoring system , and attempts to provide a brief overview of the contract of the old - aged care system . The purpose of this article is to make certain restrictions on the qualification of the guardianship party in the future because of the particularity of guardianship . Generally speaking , it is not only to abide by the partial principles of civil law and contract law , but also embody the particularity of the old guardianship . The public power organ plays an important role in the signing and performance of the contract .
