【摘要】：“勒索性提價(jià)”,是受災(zāi)害影響地區(qū)在經(jīng)濟(jì)恢復(fù)過程中,必然會(huì)出現(xiàn)的經(jīng)濟(jì)現(xiàn)象,對(duì)“勒索性提價(jià)”進(jìn)行法律干預(yù)應(yīng)著眼于受災(zāi)地區(qū)社會(huì)效益的最大化,允許災(zāi)后市場(chǎng)在一定范圍內(nèi)的漲價(jià),保證災(zāi)后市場(chǎng)供給,但漲價(jià)幅度應(yīng)在消費(fèi)者的承受范圍之內(nèi)。 我國(guó)現(xiàn)有的《反壟斷法》、《價(jià)格法》、《合同法》都無(wú)法通過現(xiàn)有的法律規(guī)定對(duì)因“勒索性提價(jià)”而遭受損失的消費(fèi)者提供法律救濟(jì)；對(duì)“勒索性提價(jià)”的法律經(jīng)濟(jì)分析表明,對(duì)“勒索性提價(jià)”的法律干預(yù)不僅僅是因?yàn)樵撔袨槭遣坏赖碌?還在于“勒索性提價(jià)”造成其他市場(chǎng)主體成本與風(fēng)險(xiǎn)的增加,而導(dǎo)致市場(chǎng)主體間實(shí)質(zhì)上的不公平； 對(duì)“勒索性提價(jià)”的法律干預(yù),可以采取三個(gè)路徑進(jìn)行：限制價(jià)格上漲比例,允許與重建相關(guān)的商品在一定幅度內(nèi)上漲；限制惡意漲價(jià),允許相關(guān)商品價(jià)格在供求關(guān)系影響下的變化,但禁止惡意漲價(jià)；全面限制價(jià)格上漲,禁止與災(zāi)后地區(qū)重建有關(guān)的商品價(jià)格的上漲；“限制價(jià)格上漲比例”,確定合理的“比例”是關(guān)鍵,“限制惡意漲價(jià)”,對(duì)“惡意”的界定是執(zhí)法的關(guān)鍵,“全面禁止”完全違背市場(chǎng)規(guī)律。
[Abstract]:The " extortion price " is an inevitable economic phenomenon in the process of economic recovery in the area affected by the disaster . The legal intervention on the " extortion price " should focus on the maximization of the social benefit in the affected area , allow the post - disaster market to increase in a certain range , and guarantee the supply of the post - disaster market , but the price increases should be within the scope of the consumer ' s acceptance . The legal economic analysis of " extortion price " is not only because the behavior is immoral , but also lies in the increase of the cost and risk of other market subjects , which leads to the infairness among the market subjects ; Legal intervention to " extortion " could take three routes : limiting the proportion of price increases , allowing commodities related to reconstruction to rise within a certain range ; limiting the price increase , allowing the price of related commodities to change under the influence of supply and demand , but prohibiting the rise of commodity prices related to the reconstruction of the post - disaster area ; limiting the proportion of price increases , defining reasonable " proportion " as the key , limiting the definition of " malicious " as the key to law enforcement , and " total prohibition " totally contrary to the market law .
