【摘要】：WTO"協(xié)商一致"的決策方式已經(jīng)不再能夠適應(yīng)國(guó)際經(jīng)貿(mào)格局的變遷�？疾閲�(guó)際組織表決方式的普遍性規(guī)律對(duì)深入認(rèn)識(shí)WTO決策方式十分必要。國(guó)際組織表決方式是國(guó)際組織的成員通過(guò)投票等方式表示贊成或者反對(duì)某項(xiàng)決議草案的安排。但是"決策"和"表決"為不同概念,前者是一個(gè)做出決定的全部過(guò)程,不僅僅限于投票表決環(huán)節(jié)。"協(xié)商一致"是"不經(jīng)過(guò)投票表決達(dá)成共識(shí)"的決策方式,它并非傳統(tǒng)的投票表決方式,其中成員之間的協(xié)商和談判最為重要。WTO"協(xié)商一致"決策方式有狹義和廣義之分。前者指WTO成員在部長(zhǎng)級(jí)會(huì)議和總理事會(huì)等決策機(jī)構(gòu)上對(duì)決議草案表示贊成或反對(duì)的過(guò)程,后者除包含前者外,更包括在決議草案提交決策機(jī)構(gòu)前WTO成員就談判議題進(jìn)行談判的程序和規(guī)則。
[Abstract]:The decision-making mode of WTO consensus can no longer adapt to the changes of international economic and trade pattern. It is necessary to investigate the universal law of voting mode in international organizations in order to deeply understand the decision-making mode of WTO. Voting by an international organization is an arrangement in which members of an international organization vote in favour of or against a draft resolution. However, "decision-making" and "voting" are different concepts. The former is the whole process of making decisions, not limited to voting. "consensus" is the decision-making method of "reaching consensus without voting", it is not the traditional voting method, among which the consultation and negotiation among members is the most important. WTO "consensus" decision-making method has a narrow sense and a broad sense. The former refers to the process in which WTO members express their support for or opposition to the draft resolution at ministerial meetings and decision-making bodies such as the General Council, while the latter includes not only the former, but also the procedures and rules for WTO members to negotiate on the subject of negotiation before the draft resolution is submitted to the decision-making body.
