【摘要】：南海"斷續(xù)線"作為中國(guó)在南海進(jìn)行權(quán)利主張的標(biāo)志,如今日漸成南海爭(zhēng)端的核心爭(zhēng)論議題,也成為國(guó)際輿論關(guān)注的焦點(diǎn)。南海"斷續(xù)線"是中國(guó)在特定的技術(shù)條件下提出的關(guān)于海洋劃界的一種模式和主張,在國(guó)際法理層面理應(yīng)得到國(guó)際社會(huì)的認(rèn)可與尊重。然而,事實(shí)并非如此。南海"斷續(xù)線"在公布后的對(duì)外傳播中,雖然在相當(dāng)長(zhǎng)時(shí)期內(nèi)并未受到任何質(zhì)疑或異議,并在相關(guān)國(guó)家和國(guó)際社會(huì)的默認(rèn)中實(shí)現(xiàn)了"歷史性鞏固",但在國(guó)際形勢(shì)變化和南海局勢(shì)持續(xù)發(fā)酵的情況下,已然成為"眾矢之的",遭到東南亞菲律賓等爭(zhēng)端方與美國(guó)等域外國(guó)家的質(zhì)疑與日益增多的指責(zé)。南海"斷續(xù)線"對(duì)外傳播成效不佳是中國(guó)在國(guó)際輿論,特別是國(guó)際海洋秩序話語(yǔ)體系中處于話語(yǔ)弱勢(shì)的結(jié)果,但這并不意味著中國(guó)的南海主張?jiān)趪?guó)際法理上存在脆弱性。為此,中國(guó)應(yīng)從完善海洋機(jī)制和重塑國(guó)際海洋秩序方面謀求話語(yǔ)權(quán)和建立優(yōu)勢(shì),進(jìn)而為南海"斷續(xù)線"在對(duì)外傳播中獲得更多的國(guó)際認(rèn)可創(chuàng)造有利條件。
[Abstract]:As a symbol of China's claim in the South China Sea, the "intermittent line" in the South China Sea has increasingly become the core issue of dispute in the South China Sea and the focus of international public opinion. The "intermittent line" in the South China Sea is a model and proposition on maritime delimitation put forward by China under specific technical conditions, which should be recognized and respected by the international community at the international legal level. However, this is not the case. In the external dissemination after the publication of the "intermittent line" in the South China Sea, although it has not been questioned or disagreed for a long time, and has realized "historical consolidation" in the acquiescence of the relevant countries and the international community, it has become a "target" under the circumstances of changes in the international situation and the continuous fermentation of the situation in the South China Sea, and has been questioned and increasingly criticized by disputes in Southeast Asia, the Philippines, and foreign countries such as the United States. The poor external communication of the "intermittent line" in the South China Sea is the result of China's weak discourse in international public opinion, especially in the discourse system of the international marine order, but this does not mean that China's South China Sea claims are vulnerable in international legal theory. Therefore, China should seek the right to speak and establish advantages in perfecting the marine mechanism and reshaping the international marine order, so as to create favorable conditions for the "intermittent line" in the South China Sea to gain more international recognition in its external communication.
