【摘要】：我國在加入WTO后的近十年國外針對(duì)我國反傾銷訴訟問題日益嚴(yán)重，特別是2006年11月21日，美國對(duì)我國銅版紙產(chǎn)品發(fā)起反傾銷和反補(bǔ)貼合并調(diào)查，并開始對(duì)我國出口的銅版紙產(chǎn)品征收臨時(shí)反補(bǔ)貼稅。而我國在積極應(yīng)對(duì)國外的“雙反”訴訟的同時(shí)也積極的采取“雙反措施”來維護(hù)自身的利益。 WTO體制下“雙反措施”已成為理論的熱點(diǎn)與難點(diǎn)。本文主要圍繞中國實(shí)施“雙反措施”的法律問題展開研究，采取理論分析與實(shí)證分析相結(jié)合的方法,從國際法和國內(nèi)法兩個(gè)層面，分析我國對(duì)外同時(shí)采取“雙反措施”的合法性合理性,在對(duì)目前國內(nèi)學(xué)界提出的應(yīng)對(duì)策略進(jìn)行分析的基礎(chǔ)上，結(jié)合本案提出自己的一些建議對(duì)策，希望對(duì)我國今后應(yīng)對(duì)類似的問題能提供參考。 本文分為三個(gè)部分： 第一部分介紹國際對(duì)華實(shí)施“雙反措施”的概況，分析國際對(duì)華實(shí)施“雙反措施”的情況以及對(duì)我國的危害性，同時(shí)對(duì)于國際對(duì)華實(shí)施“雙反措施”的法律依據(jù)進(jìn)行簡要分析。 第二部分分析中國對(duì)外實(shí)施“雙反措施”的基本概況，重點(diǎn)剖析我國對(duì)外實(shí)施“雙反措施”的情況、原因及我國學(xué)者對(duì)此的研究成果，同時(shí)指出我國對(duì)外實(shí)施“雙反措施”的法律依據(jù)等問題。 第三部分是結(jié)合國際對(duì)華“雙反措施”的實(shí)踐指出我國對(duì)外實(shí)施“雙反措施”法律完善的主要建議，從反傾銷法和反補(bǔ)貼法的實(shí)體和程序方面加以改善。
[Abstract]:In the past ten years after China's accession to the WTO, the problem of anti-dumping litigation in foreign countries has become increasingly serious. In particular, on November 21, 2006, the United States launched a combined anti-dumping and countervailing investigation on China's coated paper products. And began to export our country's coated paper products to levy a temporary countervailing duty. At the same time, China also takes "double countermeasures" to protect its own interests. Under the WTO system, "double countermeasures" has become a hot and difficult point in theory. This paper mainly focuses on the legal issues concerning the implementation of "double countermeasures" in China, and adopts the method of combining theoretical analysis with empirical analysis, from the two levels of international law and domestic law. On the basis of analyzing the legitimacy and rationality of "double countermeasures" adopted at the same time in China and abroad, on the basis of analyzing the countermeasures put forward by the domestic academic circles at present, and combining with the present case, the author puts forward some suggestions and countermeasures of his own. We hope to provide reference for China to deal with similar problems in the future. This paper is divided into three parts: the first part introduces the general situation of the international implementation of the "double countermeasures" against China, analyzes the situation of the international implementation of the "double countermeasures" against China and its harmfulness to China. At the same time, the legal basis of implementing "double countermeasures" against China is briefly analyzed. The second part analyzes the basic situation of China's implementation of "double countermeasures" with emphasis on the situation, the reasons and the research results of Chinese scholars on the implementation of "double countermeasures" with emphasis on the situation of China's implementation of "double countermeasures" outside the country. At the same time, it points out the legal basis of the implementation of "double countermeasures" in China. In the third part, according to the practice of "double countermeasures" against China, the author points out that the main suggestions to perfect the law of "double countermeasures" in China should be improved from the aspects of substance and procedure of anti-dumping law and anti-subsidy law.
