【摘要】：在國際刑法規(guī)范中,上級責(zé)任是個人刑事責(zé)任原則衍生出的一項重要原則,是軍事指揮官和其他上級人員基于其下屬實施了特定國際犯罪而應(yīng)承擔(dān)的一種刑事責(zé)任類型。從實踐價值來看,上級責(zé)任原則對指揮官和其他上級人員賦予特定的義務(wù)要求,從而將國際犯罪的刑事責(zé)任承擔(dān)者覆蓋到上級人員的不作為情形,這對于遏制國際犯罪和有效進(jìn)行國際刑事審判具有重要的意義。經(jīng)過一系列國際刑事司法實踐,上級責(zé)任的觀念和原則逐漸形成,并充分確立在國際習(xí)慣法和主要的國際性法律文件中。
[Abstract]:In the norms of international criminal law, superior responsibility is an important principle derived from the principle of individual criminal responsibility. It is a type of criminal responsibility that military commanders and other superior personnel should bear on the basis of their subordinates committing specific international crimes. From the point of view of practical value, the principle of superior responsibility imposes specific obligations on commanders and other superior personnel, thus covering the criminal responsibility bearers of international crimes to the omissions of superior personnel, This is of great significance for curbing international crimes and carrying out international criminal trials effectively. After a series of practice of international criminal justice, the concept and principle of superior responsibility has been gradually formed and fully established in international customary law and major international legal documents.
