【摘要】：20世紀(jì)后半期開(kāi)始,伴隨著世界人口大規(guī)模的自由流動(dòng),以及科技、環(huán)境、經(jīng)濟(jì)等諸多原因,傳染性疾病也開(kāi)始在全球蔓延開(kāi)來(lái)。眾所周知,多數(shù)發(fā)展中國(guó)家及不發(fā)達(dá)國(guó)家國(guó)內(nèi)欠缺完善的公共保健措施,而高藥價(jià)使其無(wú)法從外部獲得所需的藥品,所以基礎(chǔ)藥品的缺失在一定程度上引發(fā)了全球性的健康危機(jī)。“藥品專(zhuān)利強(qiáng)制許可制度”就在于解決公共健康危機(jī)的核心——藥品在世界范圍內(nèi)的普及問(wèn)題。所以在當(dāng)前環(huán)境下探討“藥品專(zhuān)利強(qiáng)制許可制度”中的法律問(wèn)題具有很高的現(xiàn)實(shí)意義。本論文分別從理論以及案例層面闡述了“藥品專(zhuān)利強(qiáng)制許可”的必要性問(wèn)題、標(biāo)準(zhǔn)問(wèn)題、程序問(wèn)題等,并結(jié)合國(guó)際條約以及國(guó)內(nèi)法給出相應(yīng)對(duì)策,以期為“藥品專(zhuān)利強(qiáng)制許可制度”的推廣提供有益的思路。 導(dǎo)論部分簡(jiǎn)要介紹了本文的研究背景,即國(guó)際及國(guó)內(nèi)公共健康衛(wèi)生共同面臨的藥價(jià)過(guò)高和通用藥缺乏的困境,并以案例引出了藥品專(zhuān)利強(qiáng)制許可在推廣中的法律問(wèn)題及其爭(zhēng)執(zhí)點(diǎn)。第一章首先提出了藥品專(zhuān)利強(qiáng)制許可中的突出問(wèn)題。簡(jiǎn)要介紹了藥品專(zhuān)利強(qiáng)制許可的必要性、以及藥品專(zhuān)利強(qiáng)制許可標(biāo)準(zhǔn)問(wèn)題與程序問(wèn)題中的問(wèn)題點(diǎn)。第二章首先以法理探討的方式說(shuō)明了藥品專(zhuān)利強(qiáng)制許可的必要性在于保障人的基本權(quán)利與保護(hù)社會(huì)公共利益,并且駁斥了藥品專(zhuān)利強(qiáng)制許可阻礙反壟斷法的觀(guān)點(diǎn)。本文隨后對(duì)藥品專(zhuān)利強(qiáng)制許可的標(biāo)準(zhǔn)問(wèn)題進(jìn)行了詳細(xì)的分析,并結(jié)合國(guó)際條約,明確了現(xiàn)行的彈性標(biāo)準(zhǔn)不利于啟動(dòng)頒布藥品專(zhuān)利強(qiáng)制許可,并得出了應(yīng)當(dāng)將藥品強(qiáng)制許可標(biāo)準(zhǔn)明朗化、國(guó)際化,方有利于使強(qiáng)制許可的價(jià)值發(fā)揮到最大化,同時(shí)防止專(zhuān)利權(quán)人利用一切可能性濫用權(quán)利。之后,本文又針對(duì)藥品強(qiáng)制許可中相關(guān)程序的合法性問(wèn)題進(jìn)行了深入分析。第三章以《涉及公共健康問(wèn)題的專(zhuān)利實(shí)施強(qiáng)制許可辦法》文本出發(fā),指出現(xiàn)階段我國(guó)僅規(guī)定了不完整的藥品專(zhuān)利強(qiáng)制許可標(biāo)準(zhǔn),且缺乏必要的救濟(jì)程序規(guī)定,只能援引參照我國(guó)《專(zhuān)利法》的相關(guān)規(guī)定。筆者建議我國(guó)今后的立法動(dòng)向應(yīng)該充分利用TRIPs協(xié)定賦予的自主權(quán),保護(hù)我國(guó)的社會(huì)公共利益。第四章是結(jié)論部分。明確了藥品專(zhuān)利強(qiáng)制許可制度是發(fā)展中國(guó)家和不發(fā)達(dá)國(guó)家應(yīng)對(duì)全球性健康危機(jī)和在國(guó)際藥品貿(mào)易尋求優(yōu)勢(shì)的關(guān)鍵。
[Abstract]:At the beginning of the second half of the 20th century, along with the large-scale free movement of the world's population, as well as many reasons such as science and technology, environment, economy and so on, infectious diseases began to spread all over the world. It is well known that most developing and least developed countries lack adequate public health-care measures and that high drug prices prevent them from obtaining the medicines they need externally, Therefore, the lack of basic drugs to a certain extent triggered a global health crisis. The compulsory licensing system of pharmaceutical patent lies in the core of solving the public health crisis-the popularization of drugs all over the world. Therefore, it is of great practical significance to probe into the legal problems in the compulsory licensing system of pharmaceutical patents in the current environment. This paper expounds the necessity, standard and procedure of compulsory licensing of pharmaceutical patents from the theoretical and case levels, and puts forward the corresponding countermeasures in combination with international treaties and domestic laws. In order to provide a useful idea for the promotion of the compulsory licensing system of pharmaceutical patents. The introduction briefly introduces the research background of this paper, that is, the international and domestic public health is confronted with the dilemma of high drug price and lack of common drugs. The legal problems of compulsory licensing of pharmaceutical patents in the promotion and the points of contention are also introduced in this paper. The first chapter puts forward the outstanding problems in the compulsory licensing of pharmaceutical patents. This paper briefly introduces the necessity of compulsory licensing of pharmaceutical patents, as well as the problems in the standard and procedure of compulsory licensing of pharmaceutical patents. The second chapter explains that the necessity of compulsory licensing of pharmaceutical patents lies in the protection of human rights and the protection of public interests, and refutes the view that compulsory licensing of pharmaceutical patents hinders the anti-monopoly law. In this paper, the issue of compulsory licensing standards for pharmaceutical patents is analyzed in detail, and combined with international treaties, it is clear that the current elastic standards are not conducive to the initiation of the promulgation of compulsory licensing of pharmaceutical patents. It is concluded that the compulsory licensing standards should be clarified and internationalized in order to maximize the value of compulsory licensing and prevent patentees from using all possibilities to abuse their rights. After that, this paper makes a deep analysis on the legality of the related procedures in the compulsory licensing of drugs. The third chapter begins with the text of "compulsory licensing measures for patent enforcement involving public health issues", pointing out that at the present stage, only incomplete compulsory licensing standards for pharmaceutical patents have been prescribed in our country, and the necessary relief procedures are lacking. Reference can only be made to the relevant provisions of the Patent Law of our country. The author suggests that the future legislative trend of our country should make full use of the autonomy conferred by the TRIPs Agreement to protect the social and public interests of our country. The fourth chapter is the conclusion. It is clear that the compulsory licensing system of pharmaceutical patents is the key for developing countries and underdeveloped countries to deal with the global health crisis and to seek advantages in international drug trade.
