【摘要】：隨著世界人口規(guī)模的擴(kuò)張,人們對(duì)海洋的利用方式不斷推陳出新,國(guó)家管轄范圍外的海域日益成為開(kāi)發(fā)利用的熱點(diǎn)。由于海洋生態(tài)環(huán)境變化的滯后性和不可逆性,海洋保護(hù)區(qū)成為保護(hù)地球最后邊疆的重要手段。在國(guó)家管轄范圍外建立海洋保護(hù)區(qū)可以有效地保護(hù)海洋生態(tài),卻也對(duì)國(guó)家的海洋權(quán)益帶來(lái)了一定的影響。著重分析在國(guó)家管轄范圍外建立海洋保護(hù)區(qū)的談判中,中國(guó)如何適當(dāng)決策,積極參與國(guó)際法規(guī)則的制定過(guò)程,為國(guó)家未來(lái)的海洋權(quán)益爭(zhēng)取到可能的發(fā)展空間。
[Abstract]:With the expansion of the world's population, the way of ocean utilization has been constantly promoted, and the sea area beyond the national jurisdiction has increasingly become a hot spot of exploitation and utilization. Due to the lag and irreversibility of the change of marine ecological environment, marine protected area has become an important means to protect the last frontier of the earth. The establishment of marine protected areas outside the national jurisdiction can effectively protect marine ecology, but it also has a certain impact on the national marine rights and interests. This paper emphatically analyzes how China should make appropriate decisions and actively participate in the process of making rules of international law in the negotiation of the establishment of marine protected areas beyond the national jurisdiction, so as to gain possible development space for the future maritime rights and interests of the country.
