【摘要】：第五管轄權是作為調整國際航空運輸某些規(guī)則的1999年《蒙特利爾公約》對華沙公約體系進行現(xiàn)代化和一體化過程中的創(chuàng)新因素之一,其功能在于能夠更加全面、公平地維護航空旅客運輸消費者的合法權益,以體現(xiàn)該公約制定的宗旨和原則。借鑒第五管轄權的創(chuàng)新性規(guī)定及對消費者權益保護的特有屬性,我國在未來修訂《民用航空法》時亦應適時加入相應條款。
[Abstract]:The fifth jurisdiction is one of the innovative elements in the modernization and integration of the Warsaw Convention system under the 1999 Montreal Convention, which regulates certain rules governing international air transport, and its function is to make it more comprehensive, To protect the legitimate rights and interests of air passenger transport consumers fairly, to reflect the purpose and principles of the Convention. With reference to the innovative provisions of the Fifth jurisdiction and the special attributes of the protection of the rights and interests of consumers, China should also include relevant clauses in the future revision of Civil Aviation Law.
